ORDER
The Government of Uttar Pradesh vide their letter no. 238/201-2016-34/1(4)/2013 dated 16.6.2016 have requested to fix seniority/year of allotment of Shri Vimal Chandra Srivastava, who has been appointed to IAS by promotion from SCS on the basis of Select List of 2007 vide this DOPT’s Notification No. 14015/22/2012-AIS-(I)-B dated 7.6.2016.
2. In this connection, it is mentioned that seniority/year of allotment of IAS officers appointed on the basis of Select List of 2007 has already been fixed. Seniority of Vimal Chandra Srivastava could not be fixed alongwith other officers as he was assessed “Unfit” by the Selection Committee. Shri Vimal Chandra Srivastava was included in the select list 2007 in pursuance of the order dated 03.11.2015 of the Hon’ble CAT Principal Bench in OA No. 948 of 2013 filed by him after review selection committee meeting held on 17.5.2016 and approved on 7.6.2016. He was appointed to IAS vide this Department’s Notification No.14015/22/2012-AIS-I dated 07.06.2016.
3. Shri Vimal Chandra Srivastava was placed below Shri Ishta Dev Prasad Rai at SI. No. 18 and above Shri Murali Dhar Dubey at SI. No. 19 in the Select List 2007.
4. In view of the above, the seniority/year of allotment of Shri Vimal Chandra Srivastava has been considered and computed under Rule 3(3) (ii) of IAS (Regulation of Seniority), Rules 1987, as amended from time to time. Weightage formula is as under:-

5.1 As per Rule 4 of the IAS (Regulation of Seniority) Rules, 1987, the officer whose name have been mentioned in the table in the select list of 2007 shall be placed below Shri Ishta Dev Prasad Rai, a promotee IAS officer of 1998 batch and above Shri Murali Dhar Dubey, a promotee IAS officer of 1998 batch of Uttar Pradesh cadre.
6. The order may be conveyed to the concerned officer.
