OFFICE MEMORANDUM

Sub: Select Lists for the years 1989 and 1990 of officers of the Central Secretariat Service (CSS) for appointment to Grade I (Under Secretary) of the Service.

The undersigned is directed to forward herewith 2 Select Lists for the years 1989 and 1990 on the above subject, prepared under Rule 12(4) of the CSS Rules, 1962, and the Central Secretariat Service (Promotion to Grade I and Selection Grade) Regulations, 1964 for appointment to the Grade I of the CSS under Rule 12(2) of the CSS Rules, 1962 as given in the Annexure I (Select List 1989) and Annexure II (Select List 1990) respectively of this Office Memorandum.

1. The order of seniority of these officers in Grade I of CSS will follow the serial order given in the enclosed Select Lists, irrespective of the actual dates of appointment to Grade I.

2. The appointment of these officers on regular basis could not be made/notified in due course for the reasons mentioned in this Department’s O.M. No.4/24/96-CS.I dated 9.5.2000. The vacancies against which officers have been included in the Select List for the year 1989 relate to the period from 1.7.1989 to 30.6.1990 and those included in 1990 Select List relate to the period from 1.7.1990 to 30.6.1991. As regular Select Lists could not be drawn within the period prescribed for such panels, due to protracted litigation and the panels have gone in arrears by almost 11/12 years, their appointments may be deemed to have been made effective with effect from 1.7.1989 and 1.7.1990 respectively for the purpose of approved service and for fixing their pay as Under Secretary on a notional basis as was allowed to officers included in the Select Lists of Grade-I (Under Secretary) for the years 1987 and 1988 with the consent of Estt. Division of this Department.

3. However, the actual benefit of higher pay on account of notional refixation will accrue from the dates of their initial appointment on ad-hoc basis ordered centrally by this Department during the years 1989 and onwards, as the case may be.383

1. The officers would be entitled for arrears on account of refixation of pay from the date of their actual appointment to the grade ordered on a centralised basis by this Department.

2. All cadre authorities of CSS are, therefore, requested to notify the appointments on a regular basis and take further action in regard to refixation of pay in respect of officers working under them and included in the Select Lists of Grade I of CSS for the years 1989 and 1990 as per above.

3. The officers who were in service on crucial dates but had retired as Section Officers subsequently on superannuation or otherwise have also been considered for inclusion in the Select Lists of Grade-I in pursuance of DOPT’s O.M. No.22011/4/91-Estt.(D) dated 12.10.1998. However, their appointments need not be notified as promotions can take place prospectively and retired persons would not be available to avail of the actual promotion from a prospective date.
