Subject: Select Lists for the years 1995 and 1996 of officers of the Central Secretariat Service (CSS) for appointment to Grade I (Under Secretary) of the Service
The undersigned is directed to forward herewith two Select Lists for the years 1995 and 1996 on the above subject, prepared under Rule 12(2) of the CSS Rules 1962, and the Central Secretariat Service (Promotion to Grade I and Selection Grade) Regulations, 1964 for appointment to the Grade I of the CSS as given in the Annexure I (Select List 1995) and Annexure II (Select List 1996) respectively of this Office Memorandum.
- The order of seniority of these officers in Grade I of CSS will follow the serial given in the enclosed Select Lists, irrespective of the actual dates of their appointment to Grade I. The appointment of officers to the post of Under Secretaries from the above two Select Lists shall be subject to the final decision in the Civil Writ Petitions filed in the High Court of Delhi by Shri R.K. Ojha and Ms. Preeti Srivastava Vs. Union of India and Others.

The vacancies against which officers have been included in the Select Lists for the years 1995 relate to the period from 1.7.1995 to 30.6.1996 and those included in 1996 Select List relate to the period from 1.7.1996 to 30.6.1997. As regular Select Lists could not be drawn within the period prescribed for such panels, due to protracted litigation and these panels have gone in arrears, their appointments may be deemed to have been made effective with effect from 1.7.1995 and 1.7.1996 respectively for the purpose of approved service and for fixing their pay as Under Secretary on a notional basis. The actual benefits, however, would be available only from the date the officers were so appointed to the post of Under Secretary.

The officers would be entitled to arrears on account of re-fixation of pay from the dates of their actual appointment to the post of Under Secretary ordered centrally by this Department. In addition, these officers shall also be entitled to exercise the benefit of option for fixation of their pay as provided under theprovisions of FP-32. However, such officers who were promoted as ad-hoc under Secretary prior to the 1st July of their Select List year and had availed of the benefit of split option, shall not be eligible to re-exercise this option.

All cadre authorities of CSS are, therefore, requested to notify the appointments on a regular basis and take further action in regard to re-fixation of pay in respect of officers working under them and included in the Select Lists of Grade I of CSS for the years 1995 and 1996. Before issuing the notifications it may also be ensured that the concerned officers are clear from vigilance angle.

The officers who were in service on crucial dates but had retired as Section Officers/Desk Officers subsequently on superannuation or otherwise have also been considered for inclusion in the Select Lists of Grade I of CSS in pursuance of DOPT’s O.M. No. 22011/4/98-Estt(D) dated 12.10.1998. However, their appointments need not be notified as promotions can take place prospectively and retired persons would not be available to avail of the actual promotion from a prospective date.
