OFFICE MEMORANDUM

Subject: Select Lists for the year 2004-2008 of the Officers of the Central Secretariat Service (CSS) for appointment to Grade-I (Under Secretary) of the Service.

Shri Debananda Sahoo (CSL No.5397), Under Secretary, Ministry of Health \& Family Welfare has been included in the Select List of Under Secretary for the year 2009 issued vide Department of Personnel \& Training O.M. No.5/11/2011-CS.I(U) dated 26.11.2012.
2. Shri Sahoo was earlier considered by the DPC for inclusion in USSLs for the years 2003 to 2008. The findings of the DPC in respect of the officer were placed in sealed covers as departmental proceedings initiated by Department of Economic Affairs were pending against him. As the disciplinary proceedings concluded with the imposition of penalty of ‘censure’, in terms of DoPT’s O.M. No.22011/4/91-Estt.(A) dated 14.09.1992 the sealed covers were not opened.
3. Aggrieved by the penalty imposed, Shri Sahoo filed an OA No.3194/2012 before the Hon’ble CAT, PB, New Delhi. The Hon’ble Tribunal vide its order dated 24.03.2015 quashed and set aside the penalty order with all consequential benefits. In compliance with the order of the Hon’ble Tribunal, Department of Economic Affairs have issued an order dated 10.06.2015 withdrawing the penalty order dated 11.11.2011.
4. Accordingly, in terms of Department of Personnel \& Training O.M. No.22011/4/91-Estt.(A) dated 14.09.1992, the sealed covers in respect of Shri Sahoo were opened. As per the recommendations of the DPC as contained in the sealed covers, approval of the President has been obtained for inclusion of Shri Debananda Sahoo in the Select List of Under Secretary of CSS for the year 2006 at SI. No.28(A), below Shri S.P. Thapliyal (CSL No.5395) at SI. No. 28 and above Shri Thomas E.V. (CSL No.5401) at SI. No.29, in the Annexure to O.M. No.5/8/2009-CS.I(U) dated 07.01.2010, subject to the conditions prescribed therein. On his inclusion in the Select List for Under Secretary for the year 2006, his name is also deleted from the Select List of Under Secretary for the year 2009.5. Ministry of Health & Family Welfare are therefore, requested to issue Notification for deletion of his name from USSL-2009 and inclusion of his name in USSL-2006 as indicated above.
