Revision of Teacher Allocations Following Supreme Court Judgment

This document addresses a misinterpretation by teachers from the Hill Sub-cadre who sought revision of their allocation to Uttar Pradesh. The Supreme Court’s judgment on May 3, 2013, actually permitted aggrieved individuals to approach the Uttarakhand High Court with their concerns, not the Central Government. The Central Government is now requesting that this information be disseminated to the concerned employees, advising them on the correct procedure. A list of teachers who submitted representations is also enclosed.

Sub.:- Representations received from teachers belonging to Hill Sub-cadre working in Uttarakhand seeking revision of allocation to U.P. as per option in pursuance of judgment dated 03.05.2013 of Supreme Court.

Sir/ Madam,

I am directed to say that a large number of representations have been received/ are being received in the Department from teachers/ lecturers of Secondary Education Department belonging to Hill sub-cadre, seeking revision of allocation to U.P. in pursuance of judgment dated 03.05.2013 of Hon’ble Supreme Court vide which the Hon’ble Court disposed of the SLP No. 24608 & 25610 of 2004 filed by Government of U.P. and Uttarakhand against judgment dated 03.06.2003 of Hon’ble Uttarakhand High Court. The copy of the judgment dated 03.06.2003 is enclosed.

The teachers have apparently misinterpreted the judgment of Hon’ble Supreme Court by representing to the Central Govt. whereas, it has permitted them to approach Uttarakhand High Court if they are aggrieved with the reasoned orders issued by the Central Govt. in pursuance of recommendations of the Advisory Committee with regard to their cases. While disposing of the SLPs, the Hon’ble Supreme Court has observed that ‘fortunately for the respondents (teachers) the direction has been issued by the High Court regarding constitution of the Advisory Committee and, therefore, what exactly would be the consequence of the report furnished by the Advisory Committee in regard to the fate of the respondents will have to be raised and addressed before the High Court itself as to whether the order passed by the Advisory Committee should be treated as final of the same is fit to be challenged. The respondents, therefore, are at liberty to approach to High Court in this regard.’ Instead of

-1-approaching Uttarakhand High Court, the teachers have represented to the Central Government for revising their allocation to U.P. as per their options. It is, therefore, requested that the contents of this letter may be brought to the notice of these employees and they may be suitably advised regarding correct course of action, if any, to be adopted by them. The copy of the list of the teachers who have submitted their representations, is enclosed.
