ORDER
Subject: Revision of seniority/year of allotment of promotee IAS officers of Rajasthan Cadre for the Review Select Lists of 2007-2012- regarding
Whereas, the Government of Rajasthan vide letter No. F.6 (2)/Pers/A-I/2012 Part dated 08.07.2020 has sent a proposal for fixation of seniority/year of allotment of promotee IAS officers who were re-appointed to IAS of Rajasthan Cadre for the Review Select Lists 2007 to 2011 vide DoPT’s Notification No.14015/19/2013-AIS-I -B dated 30th June, 2020 in compliance with the order dated 23.09.2016 passed by Hon’ble High Court of Rajasthan, Jaipur Bench in DB CMA No.104/2016, filed by Shri Ramesh Chandra Jain and others in DBCWP No.7472/2013 (Chhaya Bhatnagar Vs Uol and others).
- And Whereas, Review Select Lists from 2007 up-to 2012 have been prepared following the ratio laid down by the Hon’ble High Court of Punjab and Haryana and confirmed by Hon’ble Supreme Court of India in the matter of Shri Praveen Kumar.
- And whereas, this Department vide OM No. 14014/14/2014-AIS-I dated 18.04.2017 to apply the amended seniority regulations prospectively i.e. w.e.f. 18.04.2012. Further, the DoPT, Gol vide OM No.14014/14/2014-AIS-I dated 03.11.2017 has decided the seniority/year of allotment of officer appointed after 18.04.2012 against the vacancies arisen between 01.02.2010 to 18.04.2012 may be fixed as per pre-amended seniority rules throughout the Cadres. Furthermore vide OM No.14014/14/2014-AIS-I dated 22.01.2018 the DoPT., Gol has also decided to count the services of the officer rendered in the rank of Deputy Collector or equivalent up-to 31st December of the vacancy year against which he has been appointed to IAS.
- And whereas, the seniority/Year of Allotment of the IAS officers appointed on the basis of Review Select Lists 2007 to 2011 is to be fixed as per pre-amended seniority rules and seniority/year of allotment of the officers appointed from the Review Select List 2012 onward is to be fixed as per amended seniority rules.
- Now therefore, as per relevant rules, weightage formula for the Review Select Lists 2007 to 2011 is as under:

No. 3, 11 to 15 in the Review Select List of 2007 has been restricted under provisions of the rule 3(3) (ii) of IAS (Regulation of Seniority) Rules, 1987 which provide that an officer shall not be assigned year of allotment earlier than year of allotment assigned to other officer senior to him in that Select List or appointed on the basis of earlier Select List. 6.1 As per Rule 4 of the IAS (Regulation of Seniority) Rules, 1987, officer of Select List of 2007 mentioned at SI. No. 1 shall be placed below Shri Subir Kumar, junior most RR IAS officer of 1998 batch and above Smt. No. 2 to 6 shall be placed below Shri Bhawani Singh Detha, junior most RR IAS officer of 1999 batch and above Smt. Manju Rajpal, senior most IAS officer of 2000 batch of Rajasthan Cadre. 6.3 As per Rule 4 of the IAS (Regulation of Seniority) Rules, 1987, officers of Select List of 2007 mentioned at SI. No. 7 to 15 shall be placed below Shri Debasish Prusty, junior most RR IAS officer of 2000 batch and above Shri Naveen Jain, senior most IAS officer of 2001 batch of Rajasthan Cadre.

No. 1, 2 6 &7 in the Review Select List of 2009 has been restricted under provisions of the rule 3(3) (ii) of IAS (Regulation of Seniority) Rules, 1987 which provide that an officer shall not be assigned year of allotment earlier than year of allotment assigned to other officer senior to him in that Select List or appointed on the basis of earlier Select List.
