NOTIFICATION

New Delhi, the 15th September, 2015
G.S.R. 713 (E). -In exercise of the powers conferred by the proviso to article 309 and clause (5) of article 148 of the Constitution, and after consultation with the Comptroller and Auditor General of India in relation to persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rules further to amend the Central Civil Services (Pension) Rules, 1972, namely:-

1. (1) These rules may be called the Central Civil Services (Pension) Amendment Rules, 2015.
   (2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Central Civil Services (Pension) Rules 1972, in Form 25-
   (a) in serial No. 7, for clause (a), the following shall be substituted, namely:
   “(a) (i) Name of organisation (firm or company or co-operative society, etc.).
   (a) (ii) Brief nature of the organisation.
   (a) (iii) Full address of the registered office of the organisation.
   (a) (iv) Permanent Account Number or Tax Identification Number or Registration Number of the organisation”;
   (b) for serial number 9 , the following shall be substituted, namely:-

“DECLARATION:

I hereby declare that –
(a) I have not been privy to sensitive or strategic information in the last three years of service, which is directly related to the areas of interest or work of the organisation that I propose to join or to the areas in which I propose to practice or consult.
(b) The proposed employment will not involve conflict of interest with the policies of the office held by me during the last three years and the interest represented or work undertaken by the organisation I propose to join will not bring me into conflict with the working of the Government.
(c) The organisation in which I am seeking employment is not involved in activities which are in conflict with or prejudicial to India’s foreign relations, national security and domestic harmony. The organisation is not undertaking any activity for intelligence gathering. The employment, which I propose to take up with the organisation also will not entail activities which are in conflict with or involve activities prejudicial to India’s foreign relations, national security and domestic harmony.
(d) My service record is clear, particularly with respect to integrity and dealings with Non-Government Organisations.
(e) The proposed emoluments and pecuniary benefits are in conformity with the industry standards.
(f) I agree to withdraw from the commercial employment in case of any objection by the Government.

UNDERTAKING

I hereby solemnly declare that the above information is true to the best of my knowledge and belief and that no material information has been concealed. In the event of any of the information being found to be false, the permission may be withdrawn without assigning any reason and without prejudice to any other action that the Government may consider appropriate including action under CCS (Pension) Rules, 1972 \& criminal proceedings.

सा.का.नि. 713(अ).—राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक तथा अनुच्छेद 148 की धारा (5) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारतीय लेखा परीक्षा और लेखा विभाग में सेवा कर रहे व्यक्तियों के संबंध में भारत के नियंत्रक-महालेखापरीक्षक से परामर्श करने के पश्चात् केंद्रीय सिविल सेवा (पेंशन) नियम, 1972 में और आगे संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात् :—

1. (1) इन नियमों का संक्षिप्त नाम केंद्रीय सिविल सेवा (पेंशन) संशोधन नियम, 2015 है।
2. (2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे।
3. केंद्रीय सिविल सेवा (पेंशन) नियम, 1972, प्ररूप 25 में,
4. (क) क्रम संख्या 7 में, खंड (क) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात:-
5. (क) (i) संगठन का नाम (फर्म अथवा कम्पनी अथवा सहकारी सोसाइटी आदि)
6. (क) (ii) संगठन की संक्षिप्त प्रकृति
7. (क) (iii) संगठन के रजिस्ट्रीकृत कार्यालय का पूरा पता
8. (क) (iv) संगठन का पैन नं. (स्थायी लेखा संख्या) अथवा टिन नं. (टैक्स पहचान नं.) अथवा रजिस्ट्रीकरण नं. (रजिस्ट्रेशन नं.) “
9. (ख) क्रम संख्या 9 के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्:—

“घोषणा पत्र:

मैं यह घोषित करता हूं कि –

(क) मैं अपने मेवाकाल के पिछले तीन वर्षों में किसी संवेदनशील अथवा गुप्त जानकारी से संबद्ध नहीं रहा हूं जो कि उस संगठन के कार्य अथवा हित से संबंधित क्षेत्र जहां मैं कार्यभार ग्रहण करने का प्रस्ताव करता हूं अथवा उन क्षेत्रों से संबंधित हो जिनमें मैं व्यवसाय करना चाहता हूं या परामर्शदाता बनना चाहता हूं।

(ख) प्रस्तावित नियोजन से मेरे सेवाकाल के पिछले तीन वर्षो के दौरान अवधारित द्वारा कार्यों तथा हितों से किसी प्रकार का संधर्ष नहीं होगा, जिस संगठन में मैं कार्यभार ग्रहण करने का प्रस्ताव करता हूं उसके हितों के प्रतिनिधित्व से या किए गए कार्यों से सरकार कार्यकरण से मेरा कोई टकराव नहीं होगा।
(ग) जिस संगठन में मैं नियोजन प्राप्त करना चाहता हूं वह ऐसी गतिविधियों में अंतर्वलित नहीं है जिसका भारत के विदेशी संबंधों, राष्ट्रीय सुरक्षा तथा देशी सामंजस्य से टकराव हो या उस पर प्रतिकूल प्रभाव पड़े। यह संगठन कोई ऐसी गतिविधि नहीं चला रहा है जो आयूचना एकत्र करने से संबंधित हो। संगठन में मेरे प्रस्तावित नियोजन में ऐसी गतिविधियां सम्मिलित् नहीं होंगी, जिससे भारत के विदेशी संबंधों, राष्ट्रीय सुरक्षा तथा देशी सामंजस्य से किसी प्रकार का टकराव हो या उस पर प्रतिकूल प्रभाव पड़े।
(घ) मेरा सेवा का अभिलेख विशेषत: निष्ठा तथा गैर सरकारी संगठनों से कार्य व्यवहार के संबंध में साफ सुधरा है।
(ङ) प्रस्तावित पारिश्रमिक तथा आर्थिक फायदे उद्योग मानकों के अनुरूप हैं।
(च) मैं, सरकार द्वारा किसी प्रकार की आपत्ति की जाने की स्थिति में वाणिज्यिक नियोजन छोड़ने की सम्पत्ति देता हूं।

बचनबंध

मैं सत्यनिष्ठा से घोषणा करता हूं कि उपरोक्त सूचना मेरी जानकारी तथा विश्वास के अनुसार सत्य है और कोई तथ्यात्मक जानकारी छुपाई नहीं गई है। कोई भी सूचना मिथ्या पाए जाने की स्थिति में कोई कारण बताए बिना तथा सरकार द्वारा उचित समझे जाने पर की जाने वाली कार्रवाई, जिसमें केंद्रीय सिविल सेवा (पेंशन) नियम, 1972 तथा दांडिक कार्रवाई भी सम्मलित है, पर कोई प्रतिकूल प्रभाव डाले बिना अनुमति वापस ली जा सकती है।
