A long-standing personnel matter concerning the allocation of Smt. K. Rajeswari, a Child Development Project Officer, has been resolved. Initially allocated to Telangana in 2016, Smt. Rajeswari challenged this decision, leading to a series of legal proceedings. The Hon’ble High Court of Andhra Pradesh at Amaravati recently directed the Government of India to review her case. In compliance with the court’s order and exercising its powers under the AP Reorganization Act, 2014, the Government of India has now revised her final allocation from Telangana to Andhra Pradesh. The Andhra Pradesh Government has been instructed to accommodate Smt. Rajeswari by adjusting her against her current post, an equivalent vacant position, or by creating a supernumerary post if no suitable vacancy exists.

ORDER
Subject:- Revision of final allocation of Smt. K.Rajeswari, Child Development Project Officer, ICDS Project, Women Development and Child Welfare Directorate in compliance of the directions of the Hon’ble High Court of Andhra Pradesh at Amaravati dated 09.10.2023 in WP (AT) No. 79/2021 – regarding.
Smt. K.Rajeswari, Child Development Project Officer, ICDS Project, Women Development and Child Welfare was finally allocated to Telangana vide Order No. 29(3)/2016 dated 24.02.2016.
2. Aggrieved with her allocation to Telangana, Smt. K. Rajeswari filed an OA No.872/2016 in the then Andhra Pradesh Administrative Tribunal. The APAT ordered that her final allocation to Telangana is subject to the final result of OA. Since no quick relief in OA was received, she filed a Writ Petition No. 9724/2016 before the then Hon’ble High Court of Judicature at Hyderabad for the State of Andhra Pradesh and Telangana seeking revision of allocation. The Hon’ble High Court disposed the Writ on 31.03.2016 referring to its earlier order dated 16.02.2016 in WP No. 4359/2016 with a direction that the respondents shall not relieve the petitioner till passing of a fresh order by the Tribunal on her IA. In view of the Order of the High Court, the petitioner is continuously serving in the Andhra Pradesh till date. Subsequent to abolition of APAT and creation of a new High Court for Andhra Pradesh in 2018, the OA was transferred to the Hon’ble High Court for Andhra Pradesh at Amaravati and renumbered as WP (AT) No. 79/2021.
3. The case was disposed of by the Hon’ble High Court for the State of Andhra Pradesh at Amaravati on 09.10.2023 with the direction, as under:-

Since the issued is pending before the Government of India- $2^{\text {nd }}$ respondent herein, having regard to the nature of the controversy, this Court deems it appropriate to dispose of the writ petition, with a direction to respondent No. 2 to verify the proposals, dated 30.08.2023 and to take appropriate action/pass appropriate orders, as expeditiously as possible, preferably within a period of two months from the date of receipt of a copy of this order.”
4. Accordingly, the proposal submitted by GA (SR) Department, Government 29/05/2016-SR(S)(pt.) 2579392/2023/O/o US (SRS) I/3029742/2023 of Andhra Pradesh vide letter dated 30.08 .2023 for review and revise the final allocation of Smt.
K. Rajeswari, CPDO from Telangana to Andhra Pradesh and adjusting her against the post in which she is serving now, or in any other equivalent post under Section 77(3) of the AP Reorganization Act, 2014 was verified with the records and found appropriate to consider the same.
- Keeping in view the above facts, the Government of India, in exercise of the powers conferred under Section 77(3) of the Act and in partial modification to the order No. 29(3)/2016 dated 24.02.2016 vide F.No. 29/05/2016-SR(S), hereby revises the final allocation of Smt. K. Rajeswari, working as Child Development Project Officer in the O/o Commissioner, Women Development & Child Welfare, from Telangana to Andhra Pradesh. While giving effect to this order, the Andhra Pradesh Government shall adjust her against the post where she is serving now or against any other equivalent vacant post or create a supernumerary post in the event of non-availability of vacant post.
