A recent administrative decision has rectified the allocation of a Senior Assistant, K. Lakshmi Bai, ensuring her permanent transfer to Telangana from Andhra Pradesh. Initially allocated to Andhra Pradesh following the state reorganization, the employee sought a transfer to Telangana on humanitarian grounds, specifically due to her husband’s non-transferable central government PSU posting in Hyderabad. Despite her appeal, the State of Telangana initially did not approve the transfer.
This led to a legal challenge, where the Hon’ble High Court of Telangana intervened, allowing her petition and directing authorities to permanently allocate her to Telangana. The court’s ruling highlighted her entitlement to a vacant position in Telangana, overturning previous allocation orders. In compliance with the High Court’s directive and exercising powers under the AP Reorganisation Act, 2014, the Government of India has now officially revised her final allocation. She will be adjusted against an existing Senior Assistant vacancy in the Survey, Settlements, Land Records, and Jagir Administration, Revenue Department in Telangana.

ORDER
Subject: Revision of final allocation of Smt. K. Lakshmi Bai, Senior Assistant, Commissioner/ Director of Survey Settlements, Land Records, Settlements and Jagir Administration, Revenue Department, in compliance of order dated 12.02.2021 passed by the Hon’ble High Court of Telangana in WP No.21300/2020 – reg.
Smt. K. Lakshmi Bai, Senior Assistant, Commissioner/ Director of Survey Settlements, Land Records, Settlements and Jagir Administration, Revenue Department was allocated to Andhra Pradesh vide Order 31(1)/2015 dated 30.11.2015 (amended as Order No. 28(2)/2015 vide corrigendum dated 04.12.2015).
2. The Petitioner had opted for allocation to the State of Telangana. She was, however, finally allocated to the State of Andhra Pradesh, on recommendations of the Advisory Committee as per the allocation guidelines. After her final allocation to the State of Andhra Pradesh, the Petitioner represented for inter-state deputation / transfer to Telangana on spouse ground, as her husband is working on a nontransferable post in a Central Government PSU at Hyderabad. Aggrieved by nonconsideration / rejection of her request by the State of Telangana in 2019, the Petitioner filed the WP No. 21300/2020 before the Hon’ble High Court for the State of Telangana at Hyderabad seeking revision of her allocation from Andhra Pradesh to Telangana. The aforesaid Writ Petition was allowed by the Hon’ble High Court vide order dated 12.02.2021. The operative part of the order is reproduced below:
41. Therefore, the petitioner is entitled to be permanently allocated to the State of Telangana in one of the two vacant posts available in the said State and the respondents cannot refuse to permanently allocate her to the State of Telangana.
42. Accordingly, the Writ Petition is allowed; Order No.31(1)/2015 dt.30.11.2015 passed by the 1st respondent and G.O.Ms.No. 220 General Administration (SR-I) Department dt.31.12.2015 by the 2nd respondent are both set aside; and a direction is given to the respondents to permanently allot the petitioner to the State of Telangana on spouse ground in the vacant post of Senior Assistant (Survey) available in the office of the 8th respondent within four (4) weeks from the date of receipt of a copy of this order. No costs.3. On receipt of aforementioned order of the Hon’ble High Court and a representation of the Petitioner in this regard, the views / comments of the State Governments of Andhra Pradesh and Telangana were sought for further course of action. The Chief Secretary, Revenue Department, Government of Telangana vide letter No. 6208/Ser.I/2021 dated 02.12.2021 has now requested this Department to comply with the order dated 02.12.2021 passed by the Hon’ble High Court in WP No.21300 of 2020 filed by Smt. K. Lakshmi Bai, Sr. Assistant for revising her allocation from Andhra Pradesh to Telangana to be accommodated against the existing vacancy of Senior Assistant (Survey) in the O/o Commissioner, Survey, Settlement and Land Records, Telangana. No response has, however, been received from the State Government of Andhra Pradesh till date. It is, therefore, presumed that they have no objection in complying with the aforementioned order dated 12.02.2021 passed by the Hon’ble High Court.
- In view of the foregoing Government of India, drawing powers conferred under Sub-Section (3) of Section 77 of the AP Reorganisation Act, 2014, in partial modification of Order No. 31(1)/2015 dated 30.11.2015 (amended as Order No. 28(2)/2015 vide corrigendum dated 04.12.2015), hereby revises final allocation of Smt. K. Lakshmi Bai, Senior Assistant, Commissioner/Director of Survey Settlements, Land Records, Settlements and Jagir Administration, Revenue Department from Andhra Pradesh to Telangana.

Smt. K. Lakshmi Bai shall be adjusted against the existing vacancy of Sr. Assistant in the O/o Commissioner/Director of Survey Settlements, Land Records, Settlements and Jagir Administration, Revenue Department, as available on the appointed day i.e. 02.06.2014.
