Revised Cadre Clearance Procedure for Central Deputation Shifts

This office memorandum from the Ministry of Personnel, Public Grievances and Pension, Department of Personnel & Training outlines a revision to the procedure for cadre clearance when officers shift between Central Staffing Scheme (CSS) posts and non-CSS posts. Previously, cadre clearance was not required for such shifts. However, due to difficulties faced by State Governments in cadre management, it has now been decided that cadre clearance from the parent cadre will be mandatory for shifts between CSS and non-CSS posts, as these shifts can entail an additional two years of central deputation. The instructions are effective prospectively and are to be noted by all State Governments for information and necessary action.

OFFICE MEMORANDUM

Subject: Regulation of tenure of the officers on Central Deputation under Central Staffing Scheme -seeking of Cadre Clearance for appointments to Non-CSS posts on ‘shift’ basis -regarding.

As per the Consolidated Deputation Guidelines circulated vide DoP\&T’s OM No. 14017/33/2005-AIS (II) (Part-I) dated 28.11.2007, the provision below Para 1.2 states that “if an officer moves from a Central Staffing Scheme post to a non-Central Staffing Scheme post, or vice-versa, she/he shall be eligible for an additional tenure of two years, subject to at least two years on either post.”
2. It had been subsequently decided vide this Department’s OM of even number dated 05.09.2008 that cadre clearance from the Cadre Controlling Authority will not be required to be taken each time such shifts are made.
3. However, the provision mentioned in Para 2 above has been under active reconsideration of the Government of India for quite some time due to requests of some State Governments for a review on account of difficulties being faced by them in cadre management.
4. It has now been decided by the Competent Authority to make it necessary to obtain cadre clearance from the parent cadre for a shift from a Central Staffing Scheme post to a Non-Central Staffing Scheme post and vice versa as this entails an additional two years of central deputation.
5. All the State Governments are requested to take note of the above revised instructions for information and necessary action.
6. These instructions take prospective effect.
