Revised Allocation of Class IV Employees to Uttarakhand following High Court Directive

In a significant development concerning government personnel, a long-standing issue regarding the allocation of Class IV employees to the state of Uttarakhand has reached a resolution. This decision follows a directive from the Hon’ble Uttarakhand High Court, prompting a thorough review by an Advisory Committee.

The case involved three Class IV employees, Shri Balesh Kumar Tyagi, Ms. Sushila Devi, and Ms. Prakashvati, who were previously working in the Office of the Chief Agricultural Officer, Haridwar. Their representations, claiming an option for allocation to Uttarakhand based on previous guidelines, were carefully examined by the Advisory Committee on June 15, 2011.

The High Court had mandated a swift resolution, directing the Committee to decide on these representations within a month. After due deliberation, the Committee found merit in the employees’ claims and recommended their allocation to Uttarakhand. This recommendation was contingent upon verification of their options by the U.P. Reorganization Coordination Department.

The Government of India has now formally accepted these recommendations. Consequently, the allocation of these three Class IV employees has been revised, assigning them to the State of Uttarakhand. This final allocation remains subject to the essential verification process by the U.P. Reorganization Coordination Department, ensuring administrative accuracy and adherence to established protocols. This resolution brings clarity to the status of these employees, underlining the government’s commitment to addressing personnel matters effectively, even those stemming from complex state reorganization processes.

Sub.:- Consideration of representation of Shri Balesh Kumar Tyagi, Ms. Sushila Devi and Ms. Prakashvati, Class IV employees, in terms of direction of Hon’ble Uttarakhand High Court in Writ Petition No.110(S/B)/2011 in the meeting of the Advisory Committee held on 15-06-2011.

Sir,

I am directed to say that representations of Shri Balesh Kumar Tyagi, Ms. Susheela Devi and Ms. Prakashvati, Class IV employees presently working in the Office of the Chief Agricultural Officer, Haridwar, has been considered by the Advisory Committee in its meeting held on 15-06-2011, in terms of directions of Hon’ble Uttarakhand High Court in Writ Petition No.110 (S/B) of 2011. The Hon’ble Court in its judgment had directed the Committee to decide the representations of the petitioners as quickly as possible but not later than one month from the date of receipt of the copy of the order along with a copy of the representation already made to the Committee.

  1. The Committee found that the petitioners have claimed in their representations that they had opted for the State of Uttarakhand and recommended for their allocation to the State of Uttarakhand in terms of letter No.14 (C)/03/2006-SRS dated 02-11-2007 on the condition that their options shall be verified by the U.P. Reorganization Coordination Department.

  2. The Government of India has accepted the recommendation of the Committee and accordingly, the allocation of Shri Balesh Kumar Tyagi, Ms. Sushila Devi and Ms. Prakashvati, all Class IV employees, is hereby revised to the State of Uttarakhand subject to the condition that their
