The government has concurred with this recommendation, ensuring that the Assistant Binder’s final posting remains within the state of Uttarakhand. विषय: मुद्रण एवं लेखन सामग्री विभाग के कार्मिक श्री पंकज कुमार अवस्थी, आसिस्टैट बाइंडर से संबन्धित माननीय इलाहाबाद उच्च न्यायालय, लखनऊ खंडपीठ के दिनांक 12-12-2007 का पारित आदेश, जो रिट याचिका संख्या 58/2006 – शेर सिंह बनाम भारत सरकार एवं अन्य से लिंक किया गया है – का निपटान ।
महोदय,
मुझे उपर्युक्त विषय में यह केहने का निदेश हुआ है की माननीय इलाहाबाद उच्च न्यायालय, लखनऊ खंडपीठ ने अपने दिनांक 12-12-2007 के आदेश में निम्नलिखित आदेश पारित किया था :-
“Keeping in view the circular dated 12-11-2007, the instant appeal is disposed of directing the Committee concerned to decided the appellant’s representation in accordance with law by passing a speaking and reasoned order expeditiously and preferably within a period of 3 weeks from the date of receipt of a certified copy of this order and communicate the decision to the appellant within next one month and during this period the appellant shall be allowed to discharge his duties in the State of U.P. on the posts on which he has been promoted and will be paid his salary.”
2. अतः श्री पंकज कुमार अवस्थी, आसिस्टैट बाइंडर के प्रत्यावेदन पर दिनांक 17-10-2011 को आयोजित बैठक में परामर्शी समिति द्वारा विचार किया गया । समिति को बताया गया कि श्री अवस्थी द्वारा अपनी माता की बीमारी से ग्रस्त होने के संबंध राज्य चिकित्सा परिषद की आख्या उपलब्ध कराई गई । आख्या में यह स्पष्ट किया गया कि इन्हें पहाड़ी पर न चढ़ने एवं तनाव न लेने की सलाह दी गई । विभाग द्वारा यह अवगत कराया गया कि श्री अवस्थी की तैनाती ख्ख्की स्थित राजकीय मुद्रणालय में है और यह
उत्तराखंड राज्य का एकमात्र राजकीय मुद्रणालय है तथा रुड़की क्षेत्र उत्तराखंड की मैदानी क्षेत्र में आता है, जहाँ पर पहाड़ी होने का प्रश्न ही नहीं उठता है । प्रकरण उत्तर प्रदेश पुनर्गठन समन्वय विभाग द्वारा जारी अधिसूचना दिनांक 04 फरवरी, 2009 से आच्छादित न होने के कारण समिति द्वारा प्रत्यावेदन अस्वीकार किए जाने की संस्तुति की गई ।
- भारत सरकार समिति की संस्तुति से सहमत है तथा तदनुसार श्री पंकज कुमार अवस्थी, आसिस्टेंट बाइंडर का अंतिम आवंटन उत्तराखंड राज्य के लिए बना रहेगा । संबन्धित कार्मिक से स्थिति के बारे में अवगत करवा दिया जाए ।
