Removal of Disparity in Half Pay Leave for Industrial and Non-Industrial Employees

OFFICE MEMORANDUM

Subject:- Removal of disparity in respect of half pay leave
between industrial and non-industrial employees of
the Departments other than Railways.

The undersigned is directed to invite a reference
to Ministry of Finance O.M. No.7(84)E.IV(A)/60 dated 17th
November, 1961 as subsequently modified vide O.M. No.8(1)-EIV
(A)/70 and No.8(1)-E-IV(A)/74 dated 27.3.1971 and 15.3.1975 and
in pursuance of the Award given by the Board of Arbitration (JCM)
in CA Reference No.2 of 1983, the President is pleased to decide
as follows:-

In replacement of the existing entitlement of Half Pay
Leave in respect of industrial employees who are governed by
the Factories Act, 1948 for this purpose shall be entitled to the
Half Pay Leave at the following rates in a calendar year w.e.f
Ist January, 1985:-

(a) Half Pay Leave at the rate of 20 days per year on
completion of each year’s service.

(b) Half Pay Leave can be accumulated at the rate of
20 days per year without any limit.

(c) There will not be any ceiling on commutation of
Half Pay Leave.

(d) There is no restriction on availment of Half Pay Leave.

  1. These orders will also apply in the case of employees
    working in the Ministry of Defence (industrial workers).

  2. These orders will be applicable to all the Departmental
    industrial employees other than Railways who are governed by the
    Factories Act, 1948 and have completed a year’s service during
    the calendar year beginning with Ist January, 1986, i.e. the
    benefit of service rendered in 1985 will be given in 1986.
