Relieving of Section Officers – Rotational Transfer & Promotions

This order addresses the delayed relieving of Section Officers who were transferred or promoted under various schemes (RTP, LDCE, adhoc) in 2013. Despite multiple instructions, several Cadre Units failed to relieve these officers, hindering their regular promotions and the finalization of select lists. Consequently, the Competent Authority has ordered the immediate relieving of these officers from their current postings, directing them to report to their new Ministries/Departments without waiting for formal relieving orders. Failure to comply will result in punitive action. ORDER

WHEREAS, the Section Officers as per list enclosed were transferred and posted to different Ministries/Departments under RTP or on promotion under LDCE or on adhoc promotion vide order dated 09.01.2013 (RTP), 13.08.2013, 19.08.2013 \& 30.08.2013 (LDCE) and 31.12.2013 (adhoc).

AND WHEREAS, in terms of Rule 19 of CSS Rules, 2009, upon inter cadre transfer a CSS officer is to be relieved by the participating Ministry/Department within forty-five days of transfer orders and thereafter, the officer concerned is deemed to have been relieved by the Ministry/Department concerned to join the Ministry/Department to which he/she has been posted.

AND WHEREAS, concerned Cadre Units failed to relieve the officers even after expiry of considerable time from the date of rotational transfer orders, despite instructions dated 6.2.2013, 15.3.2013, 4.4.2013, 12.4.2013, 06.05.2013 06.06.2013, 18.07.2013, 07.10.2013 and 20.11.2013.

AND WHEREAS, those officers qualified under the LDCE 2009, 2010 \& 2011 conducted by UPSC and were supposed to join the new Ministries/Departments allocated to them on regular promotion. The non-relieving of these officers by their present Departments is denying them the benefits of regular promotion and also delaying finalization of combined Select List 2009, 2010 \& 2011 and thus creating problem for smooth cadre management.

AND WHEREAS, a decision was taken not to effect any transfer in the grade till the final results of LDCE 2012 \& 2013 were declared by the UPSC keeping in view large number of vacancies in the grade.

AND WHEREAS, UPSC has declared the final results of SO/PS LDCE 2012 \& 2013 on 04.12.2014. Accordingly, concerned cadre units were requested to relieve these officers immediately vide OM dated 05.12.2014.

AND WHEREAS, these officers have not yet been relieved by the concerned Ministry/Department.

NOW, THEREFORE, the Competent Authority in this Department hereby orders that these officers stand relieved from the rolls of the Ministry/Department where they are presently posted with IMMEDIATE EFFECT. The officers are further directed to report to the allocated Ministry/Department immediately. No formal relieving order from the Ministry/Department where they are presently posted is required. It is also informed that failure to comply with this order will make the officer(s) liable to punitive action under appropriate rules without any further notice.

iv) Director/Deputy Secretary (Admn./Estt.), Ministry/Department (as per list enclosed) with the request that the officer/officers may be allowed to join without any formal relieving order from his/her present Cadre in terms of DOP&T orders.
