RECOMMENDATIONS OF THE STATE ADVISORY COMMITTEE REGARDING FINAL ALLOCATION OF PERSONNEL OF CIVIL POLICE, DEPARTMENT OF HOME, UTTAR PRADESH TO THE STATE OF UTTARANCHAL

(Constable Cadre )

In accordance with section-76 of Uttar Pradesh Reorganisation Act-2000, the State Advisory Committee constituted by GOI for assisting the allotment of personnel to the successor States of Uttar Pradesh & Uttaranchal, after having approved the Tentative Final Allocation List of personnel belonging to Civil Police, Uttar Pradesh and after having invited representation from persons who might be affected by the aforesaid Tentative Final Allocation List, met on August 04, 2006 to properly consider and finalise its recommendations. Total 201 representations were placed before the Committee. The main objection of the representation is as follows –

(a) Being a permanent resident of Uttar Pradesh, reluctant to go to Uttaranchal.

(b) Did not opt for Uttaranchal.

(c) Due to family problem unwilling to go to Uttaranchal.

(d) That they do not possess any immovable property in Uttaranchal.

(e) That their children are getting education in Uttar Pradesh,

The views of the Civil Police, of Uttar Pradesh in respect of 201 representations were placed before the Committee. After proper consideration and due deliberations, the Committee make the following recommendations on the basis of information provided by the Home Department, Uttar Pradesh, regarding final allotment of employee.

The Committee deferred the cases of Sri Veeresh Kumar (TFAL No. 2811), Sri Rajeshwar Singh (TFAL No. 2820) and Sri Subhash Chandra (TFAL No. 3002), Sri Jamshed Ahmad Khan (TFAL No. 2123), and Qaazi Haroon (TFAL No. 3379) directed to produce dependancy certificate as well report of State Medical Board. The Committee directed to refer the cases of Sri Ram Babu (TFAL No. 2745), Sri Rajesh Kumar (TFAL No. 2756), Sri Devendra Kumar (TFAL No. 2768), Sri Ram Shankar (TFAL No.2879), Sri Narendra Jeet Singh (TFAL No. 3079), Sri Sarman Singh (TFAL No. 3232), Sri Manoj Singh (TFAL No. 3343), Sri Omkar Singh (TFAL No. 3350) and Sri Subhan Ali (TFAL No. 3382) to State Medical Board and deferred the matter. again which further action would be taken.

The Committee deferred the case of Sri Satya Prakash (TFAL No. 2754) and directed to produce the status of spouse. Final seniority, place of parting and desy, nature of wife as any other matter relating to the

The Committee deferred the case of Sri Indra Dev Mishra (TFAL No. 2805) and directed to produce disability certificate issued by Chief Medical Officer.

The Committee deferred the case of Sri Narendra Kumar (TFAL No. 2905) and directed to produce the certificate from the employer of his wife specially mentioning transferability of his wife.

These recommendations will however, be subject to court orders, if any.

(Deferred matters)

In accordance with section-76 of Uttar Pradesh Reorganisation Act-200, the State Advisory Committee constituted by GOI for assisting the allotment of personnel to the successor States of Uttar Pradesh & Uttaranchal, after having approved the Tentative Final Allocation List of personnel belonging to Stenographer and Junior Assistant (Factories) cadres of Labour Commissioner Office and after having invited representation from persons who might be affected by aforesaid Tentative Final Allocation List met on August 04, 2006 to properly consider and finalise its recommendations. The main objections of the representations are as follows:-

(a) Being a permanent resident of Uttar Pradesh, reluctant to go to Uttaranchal.

(b) Due to family problem unwilling to go to Uttaranchal.

(c) That they do not possess any immovable property in Uttaranchal.

(d) That their children are getting education in Uttar Pradesh.

The views of the Administrative Department of Uttar Pradesh in respect of representations were placed before the Committee. After proper consideration and due deliberations, the Committee make the following recommendations- on the basis of information provided by the Administrative Department, Uttar Pradesh, regarding final allotment of employee:-

(i) Stenographer- The TFAL of one employee Sri Bechai was issued against three posts allotted to Uttaranchal. Sri Bechai mentioned in his representation that S.C.. candidate should be sent, he is suffering from heart attack. His wife is unwell after brain tumor operation. The Administrative Department informed that Sri Bechai is junior most among all employees. However the Committee deferred his case and directed to produce the report of State Medical Board to substantiate his claim. We have had a heart attack on that his wife has a brain tumor.

(ii) Junior Assistant (Factories)- The TFAL of Four employees was issued against the four posts allotted to Uttaranchal against which only two representations were received. The Committee after considerations and due deliberations recommends the following four personnel to be allocation to Uttaranchal:-

(iii) Hitkari Adheekshak (Welfare Superintendent): Sri Indibar Joshi represented that his wife Smt. Preeti Joshi is an Asstt. Teacher in Uttaranchal since 2001. So he should be allotted to Uttaranchal under the spouse policy. Since Smt. Joshi has been appointed after the creation of the new state, his case is not covered under spouse policy. Further more the cadre of Hitkari Adheekshak is a dicing cadre. Hence the Committee rejected the representation of Sri Joshi.

REGARDING FINAL ALLOCATION OF PERSONNEL OF RAJYA
NIYOJAN SANSTHAN-NAVEEN PRABHAG UNDER PLANNING
DEPARTMENT

(Deferred matters)

STENOGRAPHER – In this grade 3 posts have been allocated to Uttaranchal
against which TFAL was issued for 3 personnel. Out of the 3 cases, 2
representations were received. Out of the 2 representations, the Committee
had considered the case of Sri Satguru Dayal in its meeting held on Dec 09,
2005 and directed that the report of State Medical Board be produced in
support of his heart disease. The report of State Medical Board has been
received and Sri Dayal is suffering from hypertension with IHD which requires
long term treatment. He has also been advised not to take physical exertion.
The Committee after considering the report of the State Medical Board decided
to accept his request and allocate him to Uttar Pradesh.

JUNIOR ASSISTANT/URDU TRANSLATOR – In this grade six posts
have been allocated to Uttaranchal and TFAL was issued for six employees.
The Committee has already forwarded its recommendations in three cases in its
meeting dated 7th July, 2005. Three other cases were considered in its meeting
dated 9th December, 2005, wherein the case of Shri Mohammad Mubeen was
deferred on account of the fact that Shri Mubeen had represented that the a
women employee junior to him i.e. Smt. Mahe Talat should be allocated there. to
Shri Mubeen had claimed that he is not junior most but Smt. Mahe Talat is
junior most. The Committee had directed that option/willingness of Smt. Talat
should be obtained. Now the Administrative Department has informed that ☐
Smt. Talat is neither willing to go to Uttaranchal nor has opted for it. Since
Smt. Talat is a woman employee, who has been allocated on the basis of her
option: Shri Mubeen being senior to her should not be sent in her place. The
Committee considered the representation of Shri Mubeen and accepted his
request and allot a vacancy to Uttaranchal.

while Sme Talat was the junior most
she had not opted for Uttaranchal
and did not desire to go here. As Sme
Talat’ desire to remain in us was as
per the exacting policy, she would not do
‘assisted uttaranchal’.
