Procedure for Verification of Character and Antecedents for Appointments in Tribunals/Regulatory Bodies

This office memorandum outlines the updated procedure for obtaining Intelligence Bureau reports on shortlisted candidates for Chairperson/Member/Presiding Officer/President positions in Tribunals and Regulatory bodies. Following the initial shortlisting approved by the ACC, Ministries and Departments are instructed to forward the list of candidates directly to the Intelligence Bureau for character and antecedent verification. A copy of this list should also be sent to the Cabinet Secretariat. The Intelligence Bureau will then submit its report to the Cabinet Secretariat, which will subsequently convey it to the relevant Ministry or Department. All administrative Ministries and Departments are urged to adhere to these instructions for all future selections to these posts.

OFFICE MEMORANDUM

Sub: Appointments to the posts of Chairperson/Member/Presiding Officer/President, etc in Tribunals/Regulatory bodies under purview of the ACC

In continuation of this Secretariat’s OM of even no. dated 08.01.2018 on the subject mentioned above, it is conveyed that the following procedure is to be followed for obtaining the Intelligence Bureau report in respect of the shortlisted candidates in order to verify their character and antecedents for appointment to posts of Chairperson/Member/Presiding Officer/President, etc in Tribunals/Regulatory bodies under purview of the ACC:

(i) After short-listing the candidates (2 to 3 times the number of vacancies) in the first round as approved by the ACC and conveyed to all Ministries/Departments vide communication dated 08.01.2018, the Ministries/Departments concerned may forward the list of shortlisted candidates directly to the intelligence Bureau for the purpose of verification of their character and antecedents, with a copy endorsed to the Cabinet Secretariat.

(ii) The Intelligence Bureau may thereafter submit its report in respect of the shortlisted candidates to the Cabinet Secretariat which will further convey the same to the Ministry / Department concerned.

  1. All the concerned administrative Ministries/Departments are requested to follow the above instructions in all future selections to the posts of Chairperson/Member/Presiding Officer/President, etc in Tribunals/Regulatory bodies under the purview of the ACC.
