Premature Repatriation Policy Update for Central Deputation Officers

The government has updated its policy regarding premature repatriation of officers from central deputation. The cooling-off period will not be applied to officers being repatriated to be appointed as Chief Secretary. Ministries and Departments are requested to bring this policy to the attention of concerned parties. The policy outlines procedures for officers reverting to their cadre before completing their tenure, particularly due to personal reasons or requirements from the State Government. Approval from the Appointments Committee of the Cabinet (ACC) is needed in certain cases. If recalled by the State Government for appointment as Secretary to CM/Governor, the officer will not be subjected to the extended cooling-off period.

In continuation of DoPT OM No. 5/2/94-EO(MM.II) dated 24.12.1999, it has been decided that in future in case where any officer is being repatriated to his cadre to be appointed as Chief Secretary, the condition of imposition of extended cooling-off would not be attracted.
2. The Ministries/Departments are requested to bring this policy to the notice of all concerned.

Subject: :Premature repatriation from Central Deputation reg.

According to para 17.03 of the Central Staffing Scheme, every officer shall revert at the end of his tenure, on the exact date of completing his tenure. He will, however, have a choice to revert to his cadre on the 31st May, previous to the date of the end of his tenure in case personal grounds such as children’s education etc., necessitate such reversion. According to para 17.11 ihid orders for premature reversion to the respective cadres of officers serving under the Central Staffing Scheme may be issued :
(a) By the Establishment Officer in cases where the officers wart to avail of the benefit of promotion in their cadres;
(b) By the Establishment Officer, with the approval of the Cabinet Secretary, in cases of compassionate/ personal grounds where the officer has a balance tenure of six months or less left.
2. However, if an officer wants to prematurely repatriate to his cadre on personal grounds or his services are required by the State Government and his case is not covered by any of the provisions of the Central Staffing Scheme, mentioned above, the case is submitted to the Appointments Committee of the Cabinet (ACC) for a decision. If the ACC approves of the proposal for premature repatriation, according to the extent policy, it is stipulated that the concerned officer’s name will be entertained for retention in the offer 11st for a future deputation to a post filled under the central Staffing Scheme, only after the officer has completed the prescribed period of ‘cooling off’ in his cadre, after the expiry of the unfinished tenure of his deputation on the post held by him at the time of his premature repatriation. So, the ‘cooling off’ period will be reckoned not from the date of his actual repatriation but from the date he would have finished his normal deputation term. If, however, the officer is recalled by the State Government for appointment as Secretary to CM/Governor, he would not be subjected to the extended ‘cooling off’ period.
3. All the ministries/Repartments are requested to bring this policy to the notice of the officers working in those ministries/Repartments, so that they remain appraised


of the consequences of premature repatriatron on their own request on personal grounds not covered by the provisions contained in para 17.03 and para 17.11 of the central Staffing Scheme.
