Order to Wind Up Advisory Committee for State Employee Allocation

ORDER

Whereas an Advisory Committee was constituted vide this Department’s Order No. vide Order No. 28/1/2000-SR(S) dated 21.07.2008 (copy enclosed) under the Chairmanship of Dr. S. K. Sarkar, the then Joint Secretary (In-charge of SR Division) to complete the pending allocation work of State cadre employees of erstwhile State of Bihar other than All-India services and also to consider representations received from the aggrieved employees in compliance of directions of the Hon’ble High Courts of Bihar and Jharkhand.
2. And, whereas the term of the said Committee was last extended upto 26.05.2017 (copy enclosed).
3. And, whereas, at present there are no issues relating to allocation/ representations of aggrieved employees/orders or directions of Courts, which are pending for consideration of the said Advisory Committee.
4. Now, therefore, with the consent of Successor States of Bihar and Jharkhnad, it has been decided to wind up the said Advisory Committee. Hence, the Advisory Committee for allocation matters of State employees, other than All India Services in respect of Successor States of Bihar and Jharkhand shall cease to exist from the date of this order.
5. Consequent upon winding up of the aforesaid Advisory Committee, in order to deal with representations/Courts’ orders, if any, which may arise in future on allocation matters, the following mechanism shall be followed:
(i) The representations of aggrieved employees will be considered by the Central Govt./State Governments, on a case to case basis, in compliance of Court’s directions, if, the Hon’ble Courts pass any specific directions to this effect.
(ii) If any issue regarding allocation of employees of erstwhile of State of Bihar arises in future, it will be considered by the Central Govt. in consultation with both the successor State Governments of Bihar and Jharkhand.
6. This issues with the approval of $\operatorname{MoS}(\mathrm{PP})$.

पूर्व गठित राज्य परामर्शदाजी समिति के अध्यक्ष श्री सी.एम. झा, सेवानिवृता आई.ए.एस. का कार्यकाल 30 जून, 2008 को समाप्त हो गया है । अखिल भारतीय सेवाओं को छोड़कर राज्य संदर्भ के कार्मिकों के राज्य आबंटन संबंधी शेष कार्य एवं माननीय उच्च न्यायालयों के आदेशों के अनुपालन में राज्य कर्मियों के अन्यावेदनों पर विचार करने संबंधित कार्यों को निपटाने हेतु बिहार पुनर्गठन अधिनियम, 2000 की धारा 75 के अधीन, प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय सरकार, एतदहारा, डी. एस.के. सरकार, संयुक्त सचिव, कार्मिक एवं प्रशिक्षण विभाग, की अध्यक्षता में एक समिति का गठन करती है । इस समिति का कार्यकाल, एक वर्ष अथवा अगले आदेश तक, जो पहले हो, तक होगा ।

इस समिति की संरचना इस प्रकार होगी :-

ORDER

In exercise of the powers conferred by the Section 75 of the Bihar Re-organization Act, 2000 and in continuation of this Department’s order of even number dated 26th February, 2016 (copy enclosed), the Central Government is pleased to extend the term of the State Advisory Committee, Bihar under the Chairmanship of Joint Secretary (AV), Department of Personnel & Training, Government of India to consider the representations of the aggrieved employees as well as pending allocation of State Government employees between the States of Bihar and Jharkhand in connection with the re-organization of States, other than All India Services, for a further period of three months w.e.f. 27.02.2017.
