Subject: Stepping up of pay of senior Assistants of CSS drawing less pay on promotion in the Section Officers’ Grade than their juniors – OM No.18/2/2007-CS-I dated 20.05.2014 – Follow up action regarding.
The undersigned is directed to refer to this Department’s OMs No.18/2/2007-CS-I dated 20.05.2014 and 08.07.2014 and subsequent reminder OMs No.18/2/2014-CS-I(S) dated 09.09.2014 and 30.04.2015 on the subject mentioned above. Reference is also invited to the Order of even number dated 13.07.2015 rejecting the appeals submitted by some of the CSS officers in this regard, a copy of which was also endorsed to all Ministries/Departments.
- The Ministries/Departments were requested vide OM dated 20.05.14 that stepping up of pay already allowed in cases where the individuals are not covered by the OMs dated 13.04.1988, 23.02.1994 and 08.10.1996 and where conditions laid down in the OM dated 04.11.1993 are also not fulfilled, may be reviewed and pay re-fixed accordingly. They were further requested that the excess payments made to the employees in the cases of wrong stepping up of pay may be recovered in terms of DOP&T’s OM No.18/26/2011-Estt(Pay-I) dated 06.02.2014 and a compliance report in this regard furnished to this Department by 31.08.2014.

However, till date information about re-fixation of pay, in respect of cases of stepping up of pay allowed wrongly, has been received from very few Ministries/Departments, like Ministry of Textiles, Department of Agriculture & Cooperation, Ministry of Drinking Water & Sanitations etc. A copy each of the orders so received in this Department is attached for the convenience of the Ministries/Departments to establish chain and take immediate action for re-fixation/recovery.

However, in the cases reviewed by these Ministries/Departments, many of the officers involved are presently working outside that Ministry/Department. Therefore, the compliance reports in respect of these officers are to be forwarded by their present Ministry/Department. It is also clarified that it is the responsibility of the Ministries/Departments to review all cases of stepping up allowed in respect of officers who are presently posted with them, irrespective of whether the stepping up was allowed by them or by the previous Ministries/Departments of the officer.

- The Ministries/Departments are, therefore, once again requested to furnish the compliance report in this regard immediately. If no information is to be provided, a ‘Nil’ report may be sent to this Department as a token of confirmation that all cases of stepping up of pay have been reviewed by that Ministry/ Department in terms of this Department’s OM dated 20.05.2014 read with clarifications issued vide OM dated 08.07.2014 and no violations found.

ORDER
The Department of Personnel & Training vide its O.M. No. 18/2/2007-CS.I dated 20.05.2014 has instructed to review cases of stepping up of pay of senior Assistants of the Central Secretariat Service (CSS) drawing less pay on promotion in the Section Officers Grade than their juniors and recover excess payments made to the employees in the cases of wrong stepping up of pay in terms of its O.M. No. 18/26/2011-Estt. (Pay-I) dated 06.02.2014. As per DOP\&T’s O.M. No. 18/2/2007-CS.I dated 08.07.2014, stepping up of pay is not (NOT) to be allowed where junior was drawing more pay than the senior in the lower grade i.e. Assistant Grade.
2. Accordingly, the cases of stepping up of pay of senior Assistants of the Central Secretariat Service (CSS) drawing less pay on promotion in the Section Officers Grade than their juniors in this Ministry have been reviewed in terms of DOP\&T’s O.Ms. No. 18/2/2007-CS.I dated 20.05.2014 and 08.07.2014. On review, it has been found that wrong stepping up of pay has taken place in case of the following Section Officers in this Ministry, who have since proceded to other Ministries/ Departments on their promotion as Under Secretaries:
- Shri S.K. Mahto
- Shri S.K. Babbar
- Shri M.K. Sinha
- The pay of Shri S.K. Mahto, Shri S.K. Babbar and Shri M.K. Sinha, the then Section Officers in this Ministry was stepped up at par with Shri N.K Ahlawat, the then Section Officer (now retired) in this Ministry w.e.f. 20.07.2006 i.e. the date of joining of Shri N.K Ahlawat as Section Officer in Deptt. of Commerce’s Cadre, as per the DOP\&T’s O.M. No. 18/2/2007-CS-I dated 08.08.2008 wherein it was clarified that stepping up of pay of senior Assistants of CSS drawing less pay on promotion in SOs grade than their juniors is admissible:
(i) Even if junior was drawing more pay than the senior in the lower grade i.e. in Assistant Grade;
(ii) The senior and junior were working in different cadres in the grade on Assistant;
(iii) On regular promotion to the grade of Section Officer both must be in the same cadre; and
(iv) The person who seeks the stepping up must be senior in both Assistant Grade and Section Officer Grade:

- As S/Shri S.K. Mahto, S.K. Babbar and M.K.Sinha fulfilled the conditions contained in the DOP&T’s O.M. No. 18/2/2007-CS-I dated 08.08.2008 mentioned in para 3 above, their pay was stepped up at par with Shri N.K. Ahlawat vide this Ministry’s Order No. A-19011/9/2006-Estt. dated 08.01.2010 (copy enclosed). Subsequently, the DOP&T vide its O.M. No.18/2/2007-CS.I dated 29.05.2009 withdrew its O.M. dated 08.08.2008. Further, DOP&T vide its O.M. No.18/2/2007-CS.I(S) dated 21.05.2010 instructed to maintain the status quo in the matter and also that pending representations, if any, may be kept in abeyance.

- It is clearly evident from the above Table that Shri N.K. Ahlawat was already drawing more pay than S/Shri S.K.Mahto, S.K.Babbar and M.K.Sinha in the Assistant Grade. As such, in terms of DOP&T’s O.Ms. No. 18/2/2007-CS.I dated 20.05.2014 and 08.07.2014, S/Shri S.K. Mahto, S.K. Babbar and M.K. Sinha are not entitled to

stepping of their pay at par with Shri N.K.Ahlawat and the stepping of their pay at par with Shri N.K.Ahlawat is wrong. The pay of S/Shri S.K. Babbar and M.K. Sinha was further stepped up for the second time at par with their junior Shri Raj Kumar vide this Ministry’s Order No. 19011/1/93-Estt. dated 14.06.2010 (copy enclosed). As the stepping up of pay of Shri Raj Kumar has also been found to be wrong, consequently the stepping up of pay of S/Shri S.K. Babbar and M.K. Sinha is also wrong.
8. Therefore, this Ministry’s Order No. A-19011/9/2006 dated 08.01.2010 regarding stepping up of pay of S/Shri S.K.Mahto, S.K.Babbar and M.K.Sinha at par with Shri N.K. Ahlawat and Order No. 19011/1/93-Estt. dated 14.06.2010 regarding stepping up of pay of S/Shri S.K. Babbar and M.K. Sinha at par with Shri Raj Kumar are hereby withdrawn. The Ministries/Departments, where these officers are presently working are requested to take further necessary action to refix their pay and make recovery of excess payments made to them due to wrong stepping up of pay, in terms of DOP&T’s O.M. No. 18/26/2011-Estt (Pay-I) dated 06.02.2014.

2. Accordingly, the cases of stepping up of pay of senior Assistants of the Central Secretariat Service (CSS) drawing less pay on promotion in the Section Officers Grade than their juniors in this Ministry have been reviewed in terms of DOP\&T’s O.Ms. No. 18/2/2007-CS.I dated 20.05 .2014 and 08.07 .2014 . On review, it has been found that wrong stepping up of pay has taken place in the case of Shri Vijay Kumar, Section Officer, who is presently posted as Under Secretary in the Deptt. of Revenue.
3. The pay of Shri Vijay Kumar was stepped up at par with S/Shri S.K.Mahto, S.K.Babbar and M.K.Sinha, Section Officers vide this Ministry’s Orders No. A19011/2/2003-Estt. dated 15.01.2009 and No. A-19011/13/2002-Estt. dated 11.01.2010 (copies enclosed). The pay of S/Shri S.K. Mahto, S.K. Babbar and M.K. Sinha, the then Section Officers in this Ministry was stepped up at par with Shri N.K Ahlawat, the then Section Officer (now retired) in this Ministry w.e.f. 20.07.2006 i.e. the date of joining of Shri N.K Ahlawat as Section Officer in Commerce Cadre, as per the DOP\&T’s O.M. No. 18/2/2007-CS-I dated 08.08.2008. Since Shri N.K. Ahlawat was already drawing more pay than S/Shri S.K.Mahto, S.K.Babbar and M.K.Sinha in the Assistant Grade, the stepping up of their pay at par with Shri Ahlawat has been found to be wrong, in terms of DOP\&T’s O.Ms. No. 18/2/2007-CS.I dated 20.05.2014 and 08.07.2014. Therefore, the Orders regarding stepping up of the pay of S/Shri S.K.Mahto, S.K.Babbar and M.K.Sinha at par with Shri N.K.Ahlawat have been withdrawn vide this Ministry’s Order of even number dated 07.10.2014 (copy enclosed).
4. The pay of Shri Vijay Kumar was further stepped up for the second time at par with his junior Shri Raj Kumar vide this Ministry’s Order No. 19011/1/93-Estt. dated 14.06.2010 (copy enclosed). The stepping up of pay of Shri Raj Kumar has also been found to be wrong and the order regarding stepping up of his pay has been withdrawn vide this Ministry’s Order of even number dated 07.10.2014 (copy enclosed).
- Consequently, the stepping up of pay of Shri Vijay Kumar at par with S/Shri S.K.Mahto, S.K.Babbar, M.K.Sinha and Shri Raj Kumar has also been found to be wrong. Therefore, this Ministry’s Orders dated 15.01.2009, 11.01.2010 and 14.06.2010 referred to above regarding stepping up of the pay of Shri Vijay Kumar are hereby withdrawn.
- The Department of Revenue, where Shri Vijay Kumar is presently working as Under Secretary, is requested to take further necessary action to refix his pay and make recovery of excess payments made to him due to wrong stepping up of pay, in terms of DOP&T’s O.M. No. 18/26/2011-Estt (Pay-I) dated 06.02.2014.

- As the DOP&T’s O.M. dated 08.08.2008 stood withdrawn on 29.05.2009, the stepping of pay of Shri Raj Kumar in terms of that O.M., as on 20.06.2009, is wrong. Besides, it is clearly evident from the above Table that Smt. Uma Dhall was already drawing more pay than Shri Raj Kumar in lower grade of Assistant. As per DOP\&T’s O.M. No. 18/2/2007-CS.I dated 08.07.2014, the stepping up of pay is not (NOT) to be allowed where junior was drawing more pay than the senior in the lower grade. Hence, the stepping up of pay granted to Shri Raj Kumar at par with Smt. Uma Dhall is wrong. Consequent upon stepping up of his pay at par with Smt. Uma Dhall, the pay of Shri Raj Kumar was re-fixed as stated above in Section Officer Grade including in NFSG vide this Ministry’s Orders No. A-19011/14/2004-Estt. dated 20.06.2009 and 18.02.2010 (copy enclosed) which is wrong.
- Shri Raj Kumar was granted second stepping up of pay at par with his juniors S/Shri S.K. Mahto, P.K. Sahoo and Inderjeet w.e.f. 01.07.2007 vide this Ministry’s Order No. A-19011/14/2004-Estt. dated 09.06.2010 (copy enclosed). The stepping of pay granted to Shri S.K. Mahto at par with Shri N.K. Ahlawat has been found to be wrong in terms of DOP\&T’s O.Ms. No. 18/2/2007-CS.I dated 20.05.2014 and 08.07.2014. Accordingly, the Order No. A-19011/9/2006-Estt. dated 08.01.2010 issued by this Ministry regarding stepping up of pay of Shri S.K. Mahto at par with Shri N.K. Ahlawat has been withdrawn vide this Ministry’s Order of even number dated 07.10.2014 (copy enclosed). S/Shri P.K. Sahoo and Inderjeet were granted stepping up of pay at par with Shri S.K. Mahto vide this Ministry’s Order No. A-19011/10/2005-Estt. dated 18.01.2010 and Order No. A-19011/11/2005-Estt. dated 17.03.2010, respectively, which consequently has been found to be wrong in terms of DOP\&T’s O.Ms. No. 18/2/2007-CS.I dated 20.05.2014. Therefore, the Orders dated 18.01.2010 and 17.03.2010 regarding stepping up of pay of S/Shri P.K. Sahoo and Inderjeet have been withdrawn vide this Ministry’s Orders of even number dated 07.10.2014 (copies enclosed).
- Since, the stepping up of pay in respect of Shri Raj Kumar at par with Smt. Uma Dhall, S/Shri S.K. Mahto, P.K. Sahoo and Inderjeet has been found to be wrong in terms of DOP\&T’s O.Ms. No. 18/2/2007-CS.I dated 20.05.2014 and 08.07.2014, the Orders No. A-19011/14/2004-Estt. dated 20.06.2009, 18.02.2010 and 09.06.2010 regarding stepping up of his pay are hereby withdrawn.
- The Ministry of Labour \& Employment is requested to take further necessary action to refix pay of Shri Raj Kumar, Under Secretary and make recovery of excess payments made to him due to wrong stepping up of pay, in terms of DOP\&T’s O.M. No. 18/26/2011-Estt (Pay-I) dated 06.02 .2014 .

4. Consequently, the stepping of pay of Shri P.K.Sahoo has also been found to be wrong. Therefore, this Ministry’s Order No. A-19011/10/2005-Estt. dated 18.01.2010 regarding stepping up of the pay of Shri P.K.Sahoo is hereby withdrawn.
5. ORDER
The Department of Personnel & Training vide its O.M. No. 18/2/2007-CS.I dated 20.05.2014 has instructed to review cases of stepping up of pay of senior Assistants of the Central Secretariat Service (CSS) drawing less pay on promotion in the Section Officers Grade than their juniors and recover excess payments made to the employees in the cases of wrong stepping up of pay in terms of its O.M. No. 18/26/2011-Estt. (Pay-I) dated 06.02.2014. As per DOP\&T’s O.M. No. 18/2/2007-CS.I dated 08.07.2014, stepping up of pay is not (NOT) to be allowed where junior was drawing more pay than the senior in the lower grade i.e. Assistant Grade.
2. Accordingly, the cases of stepping up of pay of senior Assistants of the Central Secretariat Service (CSS) drawing less pay on promotion in the Section Officers Grade than their juniors in this Ministry have been reviewed in terms of DOP\&T’s O.Ms. No. 18/2/2007-CS.I dated 20.05.2014 and 08.07.2014. On review, it has been found that wrong stepping up of pay has taken place in the case of Shri Inderjeet, Section Officer, who is presently posted as Under Secretary in the Minority Commision.
3. The pay of Shri Inderjeet was stepped up at par with Shri S.K.Mahto, Section Officer vide this Ministry’s Order No. A-19011/11/2005-Estt. dated 17.03.2010 (copy enclosed). The pay of Shri S.K. Mahto, the then Section Officer in this Ministry was stepped up at par with Shri N.K Ahlawat, the then Section Officer (now retired) in this Ministry w.e.f. 20.07.2006 i.e. the date of joining of Shri N.K Ahlawat as Section Officer in Deptt. of Commerce’s Cadre, as per the DOP\&T’s O.M. No. 18/2/2007-CS-I dated 08.08.2008. Since Shri N.K. Ahlawat was already drawing more pay than Shri S.K.Mahto in the Assistant Grade, the stepping up of his pay at par with Shri Ahlawat has been found to be wrong, in terms of DOP\&T’s O.Ms. No. 18/2/2007-CS.I dated 20.05.2014 and 08.07.2014. WHEREAS, Shri A.K. Jha, Under Secretary (CSL No. 7172) in the Department of Agriculture \& Cooperation submitted a representation on 10.04 .2013 for stepping of up of his pay at par with his junior Shri Inderjeet, Under Secretary (CSL No. 7202), currently posted in the Minority Commission, who was drawing more pay than him,
2. AND WHEREAS, service particulars of Shri A.K. Jha and Shri Inderjeet were compared and a statement of pay drawn by them was prepared from which it became apparent that Shri Inderjeet, being junior to Shri Jha, was drawing higher pay than him owing to stepping up of his pay at par with the pay of Shri S.K. Mahto vide Ministry of Textiles’ Order No. A-19011/11/2005-Estt. dated 17.03.2010,

AND WHEREAS, the request of Shri Jha was acceded to and his pay in the grade of Section Officer, stepped up to of Rs. 23,940/- [Rs. 18,540+Rs. 5400] w.e.f. 01.07 .2007 vide this Department’s Order No. 26022/1/2009-E.I dated 22.10.2013 as a measure to even his pay with that of Shri Indejeet Singh,
4. AND WHEREAS, Ministry of Textiles in a drive to review all previously allowed cases of stepping up found that stepping of pay of Shri Inderjeet with that of his junior Shri S.K. Mahto was wrong and, therefore, withdrew it vide their Order No. A-42011/45/2014-Estt. dated 07.10.2014,
5. AND WHEREAS, in view of M/o Textile’s Order No. A-42011/45/2014-Estt. dated 07.10.2014, the stepping up of pay of Shri A.K. Jha at par with that of Shri Inderjeet becomes automatically void warranting its withdrawal,
6. AND WHEREAS, vide this Department’s notice of even number dated 31.10.2014, Shri A. K. Jha was informed of Department’s decision to withdraw the aforesaid order of stepping up of his pay and was given an opportunity to make a representation within 5 days, which was not responded to by him,
7. NOW, THEREFORE, this Department’s Order No. 26022/1/2009-E.I dated 22.10.2013 regarding stepping up of pay of Shri A.K. Jha is hereby withdrawn and his pay is accordingly refixed w.e.f. 01.07 .2007 as under:
