This official notification from the Ministry of Personnel, Public Grievances and Pensions announces the rescission of the previous notification that established the Himachal Pradesh Administrative Tribunal. The tribunal was initially set up on September 1, 1986, under the Administrative Tribunals Act, 1985. However, following a request from the Himachal Pradesh government, and after obtaining the concurrence of the Himachal Pradesh High Court, the Central Government has now decided to abolish the tribunal. This is done in accordance with the powers conferred by the Administrative Tribunals Act, 1985, and the General Clauses Act, 1897.

साआ.नि. 509(अ).—हिमाचल प्रदेश प्रशासनिक अधिकरण की स्थापना, प्रशासनिक अधिकरण अधिनियम, 1985 (1985 का 13) की धारा 4 की उप-धारा (2) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और हिमाचल प्रदेश सरकार के अनुरोध पर, भारत के राजपत्र, असाधारण के भाग II, खंड 3, उप-खंड (i) तारीख 26 अगस्त, 1986 में प्रकाशित अधिसूचना सं. सा.का.नि. 1045(अ), तारीख 26 अगस्त, 1986 द्वारा 1 सितम्बर, 1986 से की गई थी;
और हिमाचल प्रदेश सरकार ने, हिमाचल प्रदेश उच्च न्यायालय की सहमति प्राप्त करने के पश्चात्, अब उक्त हिमाचल प्रदेश प्रशासनिक अधिकरण को समाप्त करने के लिए अनुरोध किया है;
अतः, अब, केन्द्रीय सरकार, साधारण खंड अधिनियम, 1897 (1897 का 10) की धारा 21 के साथ पठित प्रशासनिक अधिकरण अधिनियम, 1985 की धारा 4 की उप-धारा (2) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, अधिसूचना सं. सा.का.नि. 1045(अ), तारीख 26 अगस्त, 1986 को विस्वन्दित करती है।

NOTIFICATION
New Delhi, the 8th July, 2008
G.S.R. 509(E).—Whereas in exercise of the powers conferred by Sub-section (2) of Section 4 of the Administrative Tribunals Act, 1985 (13 of 1985) and on the request from the Government of Himachal Pradesh, the Himachal Pradesh Administrative Tribunal was established with effect from the 1st day of September, 1986 vide notification number G.S.R. 1045(E), dated the 26th August, 1986, published in Part II, Section 3, Sub-section (i) of the Gazette of India, Extraordinary, dated the 26th August, 1986;
And whereas the Government of Himachal Pradesh, after obtaining the concurrence of the High Court of Himachal Pradesh, has now made a request for abolition of the said Himachal Pradesh Administrative Tribunal;
Now, therefore, in exercise of the powers conferred by Sub-section (2) of Section 4 of the Administrative Tribunals Act, 1985, read with Section 21 of the General Clauses Act, 1897 (10 of 1897), the Central Government hereby rescinds the notification number G.S.R. 1045(E), dated the 26th August, 1986.
