The agenda/issues were discussed and decisions taken as follows:-
- The State Advisory Committee considered the representations received from the personnel of Civil Police Constable cadre (Junior Most) under Home Department. After due consideration and deliberations, the State Advisory Committee recorded its recommendations separately. The recommendations of the committee on the representations of the employees are enclosed for issuance final allocation orders.
- The Committee considered the following deferred cases of Civil Aviation Deptt. :-
(1) Sri Patrik D’suja, Junior Aeronautic Mechanic/Inspector mentioned that his wife is suffering from Cancer. The State Medical Board confirmed it. Hence the Committee accepted his representation. The Committee therefore recommends that Sri Patrick D’suja be exempted from allocation to Uttaranchal.
(2) Sri Ramesh Chandra Kannoujia, Junior Aeronautic Mechanic/Inspector mentioned that his unmarried and dependent sister is handicapped. C.M.O., Lucknow has confirmed that she is 60 % permanently handicapped. The Committee, therefore, recommends that Sri Ramesh Chandra Kannojia be exempted from allocation to Uttaranchal on grounds of physical disability of his dependent sister. Hence his representation is accepted.
(3) There were 10 posts of Sweeper in undivided Uttar Pradesh, out of which 02 posts have been allotted to Uttaranchal. The representative of Uttaranchal has pointed out that there is no Airport in Uttaranchal directly under the control of Civil Aviation Department. Hence, the services of sweepers are not required in Uttaranchal under the Civil Aviation Department. The Committee accepts this point of view and recommends not to allocate any posts of sweeper to Civil Aviation Department of Uttaranchal. Therefore, 02 persons Sri Anand Kumar – II and Sri Munna Lal who were proposed for Uttaranchal need not to be allocated to Uttaranchal along with a posts. -
The Committee considered the deferred matter of Sri Vikki Krishna Yadav, Food Inspector ( Pay Scale Rs. 4500-7000) in Medical and Health Deptt. His wife Smt Preeti Singh is Civil Judge in the scale of Rs. 9000-14500. Being Junior spouse the representation of Sri Vikki Krishna Yadav is accepted and he is recommended for allotment to Uttar Pradesh under the spouse policy.

Smt. Rajni Rana, Head Constable, Intelligence Deptt. has requested that she should be allotted to Uttaranchal since his husband Sri Inder Singh Rana, Sub Inspector, Civil Police has already been allotted to Uttaranchal under domicile category. Since Smt. Rana is junior spouse, she may be alowed to go to Uttaranchal under spouse policy. The Committee accepts the representations of Smt. Rana and recommends her for allocation to Uttaranchal under spouse policy.

Smt. Shama Nigar, Craft Trainer, in Samaj Kalyan Deptt. is working in the scale of Rs. 3200-4900. She has mentioned that her husband Sri Shakil Ahmad is L.J. Teacher in the Scale of Rs. 5500-9000 in Hill Sub Cadre. She has requested that she may be allotted to Uttaranchal under spouse policy. Since her husband is senior to his wife, the Committee accepted her application and recommends to allocat her Uttaranchal under spouse policy.

Sri Kuldeep Singh, Constable No. 41460 of 31st P.A.C. Battalion, Udham Singh Nagar has requested that his wife Smt. Renu Rani is House Keeper in Meerut Medical College, Meerut which is a Government institution. Since there is no medical college in Uttaranchal and she can not be transferred to Uttaranchal, he has requested to allot him back in U.P. The Committee accepted his representation under spouse policy.

Sri Harish Chandra Singh Bharti, is working as Assistant Engineer, (Civil) in Irrigation Department in Hill Sub Cadre. His wife Smt. Archana Singh is an Assistant teacher in the scale of Rs. 4500-7000 in Basic Shiksha Parishad,(U.P.) which is also a Sub-State cadre post. Sri Bharti has requeste, that he should be allotted to U.P. under spouse policy. The Committee decided that where both employees are on non transferable posts, Junior spouse may follow the senior spouse on request.

Sri Shyam Sundar Dwivedi a freedom fighter, father of Shri Manoj Kant Dwivedi has requested that his son Sri Manoj Kant Dwivedi who is an Auditor in Cooperative Societies and Panchayat be exempted from allotment to Uttaranchal. Sri Manoj Kant Dwivedi had been allotted to Uttaranchal being junior most in batch/cadre. There is not genuine reason to accept his request. However, the Committee suggest that both states can do this on transfer of service basis.

Sri Satish Kumar Kala, Pharmacist, Police Hospital, Saharanpur has mentioned that his wife Smt. Anita Kala is an Assistant Teacher under Basic Shiksha Parishad and working in Rudra Prayag, which is a local cadre. He has requested that he may be allotted to Uttaranchal under spouse policy. The Committee accepted his representation and recommends him to follow her wife in Uttaranchal under the spouse policy.

The Committee considered the representation of Sri Virendra Kumar, Driver as per direction dated June 22, 2005 of Hon’ble High Court of Judicature at Allahabad, Lucknow Bench, Lucknow in Writ Petition no. 4134/(S/S)/2005. The Committee has already considered his representation dated 05-07-2003 and He has not mentioned any new reason except the death of his wife. The Committee do not find any valid reason to accept his representation for revision of his allocation.
OTHER ITEM WITH PERMISSION OF CHAIR
Sri Narendra Kumar is working as Lekturer (Mechanical) in the Pay Scale of Rs. 8000-13500 in Technical Education Deptt. at Govt. polytechnic, Dehradun in Uttaranchal in Hill Sub Cadre. His wife Smt. Asha Srivastava is an Assistant teacher in the scale of Rs. 45007000 in Basic Shiksha Parishad in Uttar Pradesh. Sri Narendra Kumar has requested that his wife should be allotted to Uttaranchal under spouse policy. Since his wife is district level employee, the Committee considered that matter and found that Sri Narendra Kumar can not be transferred being Hill Sub Cadre employee. Similarly Smt. Asha Srivastava can also not be transferred being district level employee. Hence the Committee decided that where both employees are on non transferable posts, junior spouse may follow the senior spouse on request and so in the case of Smt Asha Srivastava.

RECOMMENDATIONS OF THE STATE ADVISORY COMMITTEE REGARDING FINAL ALLOCATION OF PERSONNEL GEOLOLY & MINING DIRECTORATE, INDUSTRIAL DEVELOPMENT DEPARTMENT OF UTTAR PRADESH TO THE STATE OF UTTARANCHAL
In accordance with section-76 of Uttar Pradesh Reorganisation Act-2000, the State Advisory Committee constituted by GOI for assisting the allotment of personnel to the successor States of Uttar Pradesh & Uttaranchal, after having approved the Tentative Final Allocation List of personnel belonging to Geology & Mining Directorate, Uttar Pradesh and after having invited representation from persons who might be affected by the aforesaid Tentative Final Allocation List, met on September 30, 2005 to properly consider and finalise its recommendations. Although many of the affected personnel submitted representation but representation of only 04 personnel were considered by the Committee, rests representations were not taken into notice by the Committee because their names were proposed against the deemed hill sub cadre posts. Description thereof given hereunder. The main objections of the representation which were considered were as follows –
(a) Being a permanent resident of Uttar Pradesh, reluctant to go to Uttaranchal.
(b) Did not opt for Uttaranchal.
(c) Due to family problem unwilling to go to Uttaranchal.
(d) That they do not possess any immovable property in Uttaranchal.
(e) That their children are getting education in Uttar Pradesh.
The views of the Geology & Mining Directorate of Uttar Pradesh in respect of 04 representations were placed before the Committee. After proper consideration and due deliberations, the Committee make the following recommendations on the basis of information provided by the Industrial Development Department, Uttar Pradesh, regarding final allotment of employee.

After deliberation the Committee directed to verify from the records whether these posts came into existence on or before the appointed date in the real term under the hill sub cadre posts and put up the actual position in the next meeting. RECOMMENDATIONS OF STATE ADVISORY COMMITTEE REGARDING FINAL ALLOCATION OF PERSONNEL OF GEOLOGY AND MINING DIRECTORATE, INDUSTRIAL DEVELOPMENT DEPARTMENT OF UTTAR PRADESH TO STATE OF UTTARANCHAL
The following personnel of Directorate of Geology and Mining met the Committee on 19-12-2005 and gave the representations for their absorption/allotment to Uttaranchal and payment of salaries :-
- Sri Naushad Ahmed Ansari, Assistant Geologist.
- Sri S.L. Patrik, Mine Officer \checkmark
- Sri Johnson Maseeh, Driller
- Sri B.K. Tyagi. Senior Clerk
The Committee had directed that their cases should be put up in the next meeting with details. As per direction the matter was put up in SAC meeting dated 19-12-2005, in which representative of Administrative Department of both states were present. After discussion it was found that the posts of Assistant Geologist and Mine Officer were created for the projects of hill area of undivided U.P. Therefore the officers appointed against these posts were finally allocated to Uttaranchal vide the Govt. of India order dated 11-09-2001.
Sri S.L. Patrik was substantively appointed against the project post. Hence he has been finally allocated to Uttaranchal vide Govt. of India order.
As far as the case of Sri Ansari is concerned, he had been promoted against the project post on ad-hoc basis and his substantive lower post was in general cadre. In his promotion order it was mentioned that if Sri Ansari came back to general cadre, he will be reverted. In the mean time the regular selection against the post of Assistant Geologist was also made through Public Service Commission, in which the recommendation of Sri Ansari was kept in sealed cover since some inquiry was pending against him. Though Sri Ansari opted for U.P. but if he is found fit against the post of Assistant Geologist, he will automatically be allotted to Uttaranchal. It was also came to the notice of the
Committee that the Hon’ble High Court, Uttaranchal has called for the sealed envelope of recommendation of the Commission, which is in their possession. Hence the Committee kept the decision pending in respect of Sri Ansari.
The post of Driller is not either project post nor hill cadre post. The Johnson Maseeh, Driller opted for Uttar Pradesh. Since the option is irreversible, his representation is rejected and he is allotted to U.P.
The post of Senior Clerk is a project post. Sri B.K. Tyagi has opted for Uttaranchal. Since he is appointed against the project post, he has already been allotted to Uttaranchal vide Govt. of India dated 11-09-2001. Hence there is no need to allot him again.
The Committee also decided that till the final allocation order of Govt. of India or the final order of Hon’ble High Court of Nainital, the Uttaranchal Govt. will pay salary and allowances to all four personnel.

RECOMMENDATIONS OF STATE ADVISORY COMMITTEE REGARDING FINAL ALLOCATION OF PERSONNEL OF GEOLOGY AND MINING DIRECTORATE, INDUSTRIAL DEVELOPMENT DEPARTMENT OF UTTAR PRADESH TO STATE OF UTTARANCHAL
The following personnel of Directorate of Geology and Mining met the Committee on 19-12-2005 and gave the representations for their absorption/allotment to Uttaranchal and payment of salaries :-
- Sri Naushad Ahmed Ansari, Assistant Geologist.
- Sri S.L. Patrik, Mine Officer
- Sri Johnson Maseeh, Driller
- Sri B.K. Tyagi. Senior Clerk
The Committee had directed that their cases should be put up in the next meeting with details. As per direction the matter was put up in SAC meeting dated 19-12-2005, in which representative of Administrative Department of both states were present. After discussion it was found that the posts of Assistant Geologist and Mine Officer were created for the projects of hill area of undivided U.P. Therefore the officers appointed against these posts were finally allocated to Uttaranchal vide the Govt. of India order dated 11-09-2001.
Sri S.L. Patrik was substantively appointed against the project post. Hence he has been finally allocated to Uttaranchal vide Govt. of India order.
As far as the case of Sri Ansari is concerned, he had been promoted against the project post on ad-hoc basis and his substantive lower post was in general cadre. In his promotion order it was mentioned that if Sri Ansari came back to general cadre, he will be reverted. In the mean time the regular selection against the post of Assistant Geologist was also made through Public Service Commission, in which the recommendation of Sri Ansari was kept in sealed cover since some inquiry was pending against him. Though Sri Ansari opted for U.P. but if he is found fit against the post of Assistant Geologist, he will automatically be allotted to Uttaranchal. It was also came to the notice of the
Committee that the Hon’ble High Court, Uttaranchal has called for the sealed envelope of recommendation of the Commission, which is in their possession. Hence the Committee kept the decision pending in respect of Sri Ansari.
The post of Driller is not either project post nor hill cadre post. The Johnson Maseeh, Driller opted for Uttar Pradesh. Since the option is irreversible, his representation is rejected and he is allotted to U.P.
The post of Senior Clerk is a project post. Sri B.K. Tyagi has opted for Uttaranchal. Since he is appointed against the project post, he has already been allotted to Uttaranchal vide Govt. of India dated 11-09-2001. Hence there is no need to allot him again.
The Committee also decided that till the final allocation order of Govt. of India or the final order of Hon’ble High Court of Nainital, the Uttaranchal Govt. will pay salary and allowances to all four personnel.
