MINUTES OF THE SIXTH MEETING HELD ON 08.02.2008 AT 11.00 AM AT BHOPAL UNDER THE CHAIRMANSHIP OF JS(A&AT&CS)

In compliance with the directions dated 17.04.2007 of the Hon’ble High Court of Chhatisgarh at Bilaspur in Writ Petition No. 445/2007 in the matter of Godbole and others versus Union of India and others, the 6th meeting was held under the Chairmanship of Dr. S. K. Sarkar, Joint Secretary (A&AT and CS), DOPT at 11.00 Hrs at Bhopal in Madhya Pradesh since preoccupation with urgent work at New Delhi Shri C. B. Paliwal, Joint Secretary (E) could not chair the meeting. The meeting was attended by the following:

The Chairman welcomed the members of the Committee and thereafter took up the agenda of the meeting for discussion. In the meeting, the representations of state Government employees of erstwhile state of Madhya Pradesh, covered by the decision dated 17.04.2007 in W.P. No. 445/2001 were individually discussed for revision of their allocation of state Cadre. The brief record of discussion/decision in each case has been reflected in the last column of the table.

The Committee recalled that the State Advisory Committee (SAC) had considered the issue of allocation of revenue inspectors under the provisions of the state Re-organization Act, 2000, and it was found that they are not the state cadre employees. His allocation has been made as per the guidelines. Hence the Committee did not recommend for revision of his allocation.
46 Dubraj Singh Kanwar, Distt Revenue Officer 2900/03 The employee has been allocated to Chhatisgarh on the basis of his option and domicile. Hence the Committee did not recommend for revision of his allocation.
47 Chandra Sekhar Srivastava, depot Manager 5915/07 The employee is working in the Madhya Pradesh Roadways Transport Corporation. The employees of State Corporations are to be allocated by the Ministry of Home Affairs. Allocation of Shri Chandra Sekhar Srivastava will be decided by the Ministry of Home Affairs
48 R P Shukla, D/O Animal Husbandry, Asstt Surgeon 6477/06 Shri Devendra Kumar Shukla, the advocate of the petitioner viz Shri R.P. Shukla, appeared before the Committee to plead the case for allocation to Madhya Pradesh. As per the comments furnished by the M P Government it was not clear whether the Shri Shukla belongs to D/o Panchayat Raj and Rural Development or the D/O Animal Husbandry. The consideration of this case was deferred and it was decided to make available details/documents to General Administration Department regarding the Department to which the claimant belongs for deciding the allocation of Shri R P Shukla in the next meeting of the Committee.

50 Jawahar Lal Sisodia, Sub Inspector 6591/05 Deferred

The Committee decided that the matter would be inquired from the Ministry of Home Affairs whether they have constituted any Committee to consider the representations of employees of Madhya Pradesh in compliance of directions dated 17.04.2007 of Hon’ble High Court of Chhatisgarh at Bilaspur. The Committee was of the view that it can recommend the allocations of employees of MP, falling within the purview of MHA, for allocation if needed, so that compliance of Court said directions is informed to the Hon’ble Court.The Chairman suggested that we may write a letter to the Government Counsel at Bilaspur for seeking extension of time for three months i.e. up to 18.05 .2008 from the Hon’ble High Court of Chhatisgarh for consideration of representations of remaining employees of the state Government employees covered by the order dated 17.04.2007. It was also decided that next meeting of the Committee would be held in Raipur, Chhatisgarh to decide the representations of remaining employees covered by the order of the Hon’ble High Court.
