Minutes of 27th meeting Advisory Committee, M.P. to consider the representations of the employees of erstwhile State of M.P. held on 6th October, 2016 at Bhopal, M.P.

The 27th meeting of Advisory Committee, M.P. was held on 06.10.2016 at Vallabh Bhavan, Bhopal, M.P. The Chairperson of the Committee, Smt. Archana Varma, Joint Secretary, DOP&T, Govt. of India could not attend the meeting due to some exigencies and she directed Ms. K. Kipgen, Director (SR) to chair the Committee on her behalf with the approval of Secretary (Personnel), Govt. of India. Accordingly, the Committee was chaired by Ms. K. Kipgen, Director (SR), DOP&T, Govt. of India to consider the policy matters, the representations of the petitioners/employees and court matters relating to allocation of erstwhile State of M.P. The Principal Secretary, Department of General Administration, Govt. of M.P. and the Secretary, Department of General Administration, Govt. of Chhattisgarh, the members of the Committee could not attend the meeting due to some exigencies. Both States were represented by Smt. Usha Parmar, Deputy Secretary, GAD, M.P. and Shri K. R. Mishra, Additional Secretary, GAD, Chhattisgarh. The list of attendees is enclosed at Annexure-I.

  1. At the outset, Ms. K. Kipgen, Director (SR) on behalf of the Chairperson welcomed the Members and other attendees in the meeting. It was noted that the bifurcation of the States took place 16 years ago and final allocation was made almost 14 years ago. She therefore, emphasised the need for winding up the Advisory Committee by March, 2017. Both representatives of the two State Governments also agreed to the same. However, the modalities for winding up will be worked out with the consent of both the States subsequently. As per agenda item, the matter pertaining to 28 Departments were discussed department-wise.

  2. As agreed by both the State Governments the following two issues were ratified during the meeting:

(i) the cut-off date for retention of those employees due to retire within 2 years effective form 01.04.2016

(ii) last date of receipt of representation has been fixed as 31.03.2016

Accordingly, both the State Govts. were requested to widely publish the decision.

However, the Committee admitted the representations received till the date of meeting i.e. 06.10.2016 for consideration. Accordingly, as per agenda 8 employees due to retire by March, 2018 were recommended for retention in MP/Chhattisgarh respectively. Further the representations for change in the allocation in respect of 114 employees were also considered.

  1. In addition, the Committee examined 148 pending Writ Petitions/Appeals, etc. and undated the details. The Committee further suggested that the concerned Departments shall appoint Officer-in-charge in respect of all legal matters relating to allocation and the status of hearing in the respective High Courts regularly. It was also observed by the Committee that at least 80-90% of the pending cases were as old as

2005-2013. The Committee therefore impressed upon those departmental representatives present to request their respective Counsels and Advocate General to get all the pending cases duly mentioned/represented before the Courts and take necessary steps for expediting their disposal.
5. The Committee noted that as reported by the concerned administrative Departments many petitioners have retired/expired during pendency of the writ petitions/appeals filed in the Hon’ble High Courts. The Committee desired that in all these cases Miscellaneous Applications may be filed by the respondents respectively in terms of guidelines dated 11.08 .2008 issued by Govt. of India for quick disposal of these cases. The Committee further desired that in respect of all such court cases which are covered by the decision taken by the Committee in para 3 (i) above i.e. retention of those employees due to retire within 2 years effective from 01.04.2016, miscellaneous applications may be filed by the both the State Govts. as well as by the Central Govt. informing the Courts about the decision and request for disposal of these cases.
6. As regards representations/writ petitions/compliance of Court’s orders for revision of allocation, the Committee considered 114 cases in total. The decision taken during the meeting are as given below. The recommendations of the Committee in each of these 114 cases are at Annexure-II.

The Administrative Department informed that Shri Sone belongs to SC category and is domicile and optees of Chhattisgarh. He was allocated to Chhattisgarh as per his option for Chhattisgarh (A-2 category). They further informed that as per service records his home district is Bilaspur in Chhattisgarh.
The Committee noted that the SC/ST employees who are domicile/optee of any of the successor States are only eligible for revision of allocation under the revised guidelines dated 28/29.07.2008 \& 24.06.2010 for allocation of SC/ST employees. The Committee further noted that Shri Sone is neither domicile nor optee of State of M.P. Therefore, he is not eligible for revision of allocation from Chhattisgarh to M.P. under extant guidelines on allocation for SC/ST employees. In view of the above confirmation/facts, the Committee recommended rejection of representation of Shri Sone. A speaking order shall be issued accordingly.

The Committee noted that Shri Chaurasia was allocated to Chhattisgarh under A-3 (home district) category as per existing guidelines of allocation. In the absence of any documentary proof in support of his claim that his wife is victim of Bhopal Gas Tragedy, his request can not be considered under the guidelines of allocation. The Committee, therefore, recommended rejection of his representation.

(i) 65 Medical Specialist (names mentioned in the representation) junior to him were in the pay scale of Rs. 12000-16500 but were allocated to M.P. in the pay scale of Rs. 10000-15200
(ii) Dr. Ram Chandra Sharma and 23 others (names

mentioned in the representation) Specialist doctors junior to him were in the pay scale of Rs. 12000-16500 but were allocated to M.P.
The Administrative Department did not furnish information regarding allocation of doctors junior to Dr. Neema to M.P. and grant of ACP to above juniors with retrospective effect on/prior to 23.09 .2000 , notwithstanding the fact that orders to this effect were issued after publication of TFAL and they were allocated to M.P. in lower pay scale.
The Committee desired that specific information alongwith recommendations of the Administrative Department may be provided to the Central Govt. immediately after receipt of the minutes. The Committee, accordingly, deferred the matter.
79 65 Shri Rajendra Singh Bhadoriya, Sub-Engineer, D/o Public Health Engineering W A No. 321/2011 The Committee considered the representation made earlier by Shri Bhadoria in compliance of directions dated 13.3.2014 passed by the Hon’ble High Court in WA No. 321/2011. The petitioner raised the following grounds in his earlier representation:-
(i) He is domicile of M.P., had opted for M.P. but was allocated to Chhattisgarh against his option.
(ii) His juniors viz. Shri Ghanshyam Aggarwal (Sl. No. 1358), Shri Satnish Prakash Sahu (Sl. No. 1369), Shri Kailash Chandra Pansari (Sl. No. 1362) were allocated to State of M.P.
(iii) Allocation of Sub-Engineers to the State of Chhattisgarh was made in excess to the laid down percentage of 26.23 .
The Administrative Department did not inform whether these juniors were given the benefit of ACP in the pay scale of Rs. $8000-13500$ with retrospective effect on/prior to 23.09 .2000 but orders to this effect were issued after publication of TFAL and they were allocated to the State of M.P. in lower pay scale.
Therefore, the Committee instructed the Administrative Department to re-examine and resubmit the matter. The Committee accordingly deferred that matter.

Shri Bajpai contended that his juniors viz. Shri Jagdish Chandra Joshi (S.No.1435B), Shri Pankaj

Malhotra (S.No.1444) and several other persons were allocated to M.P. Further, Shri Har Swaroop Gaur and Shri S.P. Shrivastava, who were finally allocated to Chhattisgarh, are still working in the State of M.P.

The Administrative Department informed that Shri Joshi and Shri Malhotra were allocated to M.P. under swap/mutual transfer and medical grounds respectively. Shri Gaur and Shri Srivastava are working in M.P. in compliance of Court’s order because they have been granted stay.

Therefore, the Committee recommended rejection of representation of Shri Bajpai :
(i) Since 2 of his juniors were allocated to M.P. under mutual transfer/medical grounds.
(ii) The other 2 juniors were retained in M.P. as there is a stay on their final allocation.

A speaking order shall be issued accordingly.

The Committee considered the representations dated 21.10.2003 & 02.03.2015 submitted by Shri Wallabhdas in compliance of directions dated 22.09.2003 of the Hon’ble High Court of M.P. to the Central Government for deciding the fresh representation submitted by Shri Wallabhdas.

The Committee observed that Shri Wallabhdas has raised following grounds:
(i) His home district is in the State of M.P. and he had opted for M.P. at the time of allocation.
(ii) His mentally disturb and physically unfit aunty (bua ji), who is completely dependent on him, is suffering from chronic urinary disease and getting treatment from Indore, M.P.
(iii) 11 Scientific Officers, appointed in 1985, were not given the benefit of kramonnati vetanman (ACP) at the time of allocation.

The Administrative Department informed that Shri Wallabhdas was allocated to Chhattisgarh against his option for M.P. under junior most category (A-4). His Buaji is not residing with him at his residence at Indore, M.P. They further informed that 11 Scientific Officers, appointed in 1985, were not given the benefit of kramonnati vetanman (ACP) at the time of allocation.


The Committee noted that only domicile and option do not confer a right for allocated to opted state. Moreover, Bua ji does not come under the definition of family. The Committee further observed that the Administrative Department did not provide details of 11 Scientific Officers, appointed in 1985, who were not given the benefit of kramonnati vetanman (ACP).
The Committee instructed the Administrative Department to provide the specific information as to whether these juniors were given the benefit of ACP in with retrospective effect on/prior to 23.09 .2000 but orders to this effect were issued after publication of TFAL and they were allocated to the State of M.P. in lower pay scale. The Committee accordingly deferred the matter.

The Committee observed that Shri Chhawai was finally allocated to the State of Chhattisgarh under swap with Shri Shivshankar Sharma. But he did not join the State of Chhattisgarh and filed writ petition No.2074/2005 before the Hon’ble Court for quashing his relieving order dated 23.06 .2005 to the State of Chhattisgarh issued by Govt of MP. The said order was quashed by the Hon’ble Court vide its order dated 08.10.2007 passed in W.P. No.2612/2007 filed by Shri Chhawai.
However, vide representation dated 23.09 .2008 submitted to the Govt. of India Shri Chhawai requested to relieve him for the State of Chhattisgarh.
In view of above, both the State Govts. were requested by the Central Govt. to take appropriate action to relieve him for joining the duty in the State of Chhattisgarh.
The Committee observed that the Department of Home, Govt. of M.P. did not relieve Shri Chhawai and instead sought opinion/decision taken by the Central Govt. in the matter.
The Committee recommended that legal opinion may be sought by the Govt. of M.P. in the matter. It may be re-examined accordingly and a proposal may be sent to the Govt. of India immediately after receipt of the minutes.

Since 26 junior RAEOs to Shri Mishra were given the benefit of ACP with retrospective effect and allocated to the State of M.P, the Committee recommended revision of allocation of Shri Mishra from Chhattisgarh to M.P.

No.1138/2010 passed by the Hon’ble High Court of M.P. The Committee observed that the Hon’ble High Court quashed the allocation order to the State of Chhattisgarh in respect of petitioner and allowed him to remain in the State of Madhya Pradesh.
The Committee noted that Shri Sharma has raised following grounds in writ petition:-

In compliance of directions dated 03.03 .2015 in W.P. No.7443/2010 passed by the Hon’ble High Court of Chhattisgarh, the Committee considered the representation of Shri Soni. The Committee observed that the Court directed that on submission of representation, if any, by the petitioner, it would be entirely for the competent authority to act in accordance with law without being influenced by any observation made by this court.
The Committee noted that Shri Soni submitted a representation regarding revision of allocation from Chhattisgarh to M.P. on following grounds:-
(i) He is a permanent resident of M.P. and opted for M.P.
(ii) Both the State Govts. i.e. M.P. \& Chhattisgarh have given their consent/NOC on change of his State allocation.
(iii)The Directorate of Veterinary Services informed that there were in all 110 sanctioned posts of Progress Assistant in M.P., of which, there are only 99 posts being occupied and 11 posts are vacant.
The Committee noted that both the State Govts i.e. M.P. and Chhattisgarh have informed that home district of Shri Soni is Narsinghpur, M.P. He had opted for M.P. at the time of allocation. They have given their consent/NOC for change of allocation of Shri Soni. Moreover, Govt of M.P. has informed that 78 employees are working on the post of Progress

Assistant and 32 posts are vacant in the department.
The Committee noted that mutual transfer is not under the ambit of the Advisory Committee. Hence, it is left to the both the State Govts. to decide the matter.
90 76 Shri Bhaiyaram Bhagat, MPW, D/o Public Health \& Family Welfare WP No. 4043/2005 The Administrative Department of Shri Bhagat informed that he is a non-State Cadre employee. NonState Cadre employees stood allocated to the State where they were working as on the appointed day i.e. 01.11.2000. The Committee noted that no separate orders for allocation of non-State cadre employee were issued. Therefore, consideration of allocation of Shri Bhagat does not fall within the purview of Advisory Committee. Therefore, the Committee recommended rejection of his representation.
91 77 Shri Anand Kumar Mishra, Sub-Engineer, D/o Public Works WA No. 469/ 2012 The Committee observed that while disposing of W.A. No.469/2012 on 18.11.2015, the Hon’ble High Court of M.P., Bench at Gwalior directed the Central Government to reconsider the representation made earlier by the petitioner against his allocation and pass speaking order and communicate the same to the petitioner within a period of 60 days from the date of receipt of certified copy of this order.
The Committee noted that Shri Mishra raised the following grounds in his representation:
(i) His juniors viz. S/Sh. Dhirendra Singh, V.P. Bhadoria, Sudheer Kumar, J.P. Shori, Gyanendra Singh and Manoj Jain were allocated to M.P.
(ii) He is entitled for benefits of seniority w.e.f. 20.03.1996 on parity basis with Shri Vishambhar Singh Bhadoria, Shri Ravindra Sharma and Shri Ram Niwas as per court’s order but the respondents treated him as SubEngineer as on 31.12.1998 while allocating him the State of Chhattisgarh and the SubEngineers as on 20.03.1996 have been allocated State of M.P.
The matter was deferred with directions to the Administrative Department to submit the requisite information immediately.
92 78 Shri Jitendra Singh Chauhan, Company Commander, D/o Home WA No. 400/2011 In compliance of directions dated 10.3.2014 in Writ Appeal No.400/2011 passed by the Hon’ble High Court of MP, Bench at Gwalior, the Committee considered that representation of Shri Chouhan.
The Committee observed that he has raised

following grounds in his earlier representation regarding revision of State allocation from Chhattisgarh to M.P.:
(i) His home district is Bhind, M.P.
(ii) He is suffering from ‘pancreatitis’ and getting treatment from Agra.
The Administrative Department informed that Shri Chouhan was allocated to Chhattisgarh against his option on juniority basis in accordance with the guidelines. Only domicile does not confer a right to allocation of opted State. The Committee noted that pancreatitis is not covered under medical hardships. Therefore, the Committee recommended rejection of his representation. A speaking order shall be issued accordingly.

But Department of General Administration, Chhattisgarh informed that Shri Garg has not yet given joined in Chhattisgarh after his final allocation.
The Committee observed that Shri Garg had filed W.P. No. 827/2008 in the Hon’ble High Court of Chhattisgarh which was dismissed. Thereafter, he preferred the present Writ Appeal No. 152/2009 which has also been disposed on 18.3.2010. However, the directions are not available with the Central Govt. The Committee further observed that Shri Garg mentioned his posting address as Block Bilha, District Bilaspur, Chhattisgarh and residential address as Rajkishor Nagar, Chhattisgarh in the writ appeal. As such he appears to be serving under the Govt. of Chhattisgarh.
In view of the above, the Committee desired that the position may be verified by the Govt. of Chhattisgarh and intimated to the Govt. of M.P. as well as Govt. of India immediately after receipt of the minutes. The Committee also instructed that a copy of

order dated 18.3.2010 of the Hon’ble High Court of Chhattisgarh may also be obtained by the Administrative Department and submit to Govt. of India.

The Committee recommended that it may be confirmed by both the State Govts. whether he has been relieved from M.P. and joined in the State of Chhattisgarh. A copy of relieving order and joining report may be provided to the Govt. of India immediately after receipt of the minutes. The Committee accordingly recommended to drop the case.

No.4477/2013 on 24.02.2014, the Hon’ble High Court of Chhattisgarh directed the Secretary, General Administration, Govt. of Chhattisgarh to consider and decide the fresh representation/application of the petitioner, on its own merits, in accordance with

circular dated 9.6.2008 issued by the State Govt.
The Committee noted that the directions are given to the State Govt. and the Govt. of India is not the respondent in the matter. Moreover, the petitioner has not approached the Govt. of India for redressal of his grievance. Govt. of Chhattisgarh has already given its consent/No objection.
In view of the above, the Committee recommended that necessary action in compliance of Court’s order may be taken by the both the State Govts. as per the terms/conditions/rules/regulations framed for this purpose.
99 85 Dr. Rajesh Joshi, AMO, D/o Ayush W.P. No. 3065/2006 The Committee noted that this case is being repeatedly deferred for last few meetings for want of complete information/ clarification/specific comments from the Administrative Departments.
The Committee observed that while disposing of W. P. No. 3065/06 on 15.11 .2011 , the Hon’ble High Court of M.P. Bench at Indore granted liberty to the petitioner to submit a representation raising all possible grounds before the Committee and the Committee shall pass necessary order. In compliance of said directions dated 15.11 .2011 , the petitioner submitted a representation dated 22.01 .2013 to this Department for revision of his allocation from Chhattisgarh to M.P. Dr. Joshi contended that some AMOs were not given the benefit of ACP and were allocated to M.P. in lower pay scale being senior in that pay scale and his junior AMOs were allocated to M.P.
The Committee noted that in its last meeting, the Department of Ayush, M.P. opined to retain Ayurvedic Medical Officers (AMOs) who have not joined the State of Chhattisgarh in compliance of Court’s order and are still working in the State of M.P. and due to shortage of AMOs in M.P. they are proposed to have been retained in M.P. The Administrative Department reiterated that same.
The Committee further instructed the Administrative Department to provide their specific comments on allocation of junior AMOs to M.P. in lower pay scale and clarify as to whether these juniors were given the benefit of ACP with retrospective effect after the cutoff date i.e. 23.09 .2000 but effective on/prior to 23.09.2000. The Hon’ble Court further held that it would not be just and proper to again refer the matter to the appropriate Government for deciding the representation of the petitioners.

Shri Tomar is due to retire on 31.1.2017. Therefore, the Committee recommended his retention in M.P.
