The 23rd meeting of the State Advisory Committee convened to discuss the allocation of state cadre employees to the successor states of Andhra Pradesh and Telangana. MINUTES OF THE 23rd MEETING OF THE STATE ADVISORY COMMITTEE ON ALLOCATION OF STATE CADRE EMPLOYEES TO THE SUCCESSOR STATES OF ANDHRA PRADESH AND TELANGANA HELD AT 2.00 PM ON 28-08-2017 AT HYDERABAD.

  1. Pending cases of allocation of employees

a & b. Allocation of Deputy Collectors and Special Grade Deputy Collectors & DSPs, Addl. SPs & SPs (Non Cadre)

In regard to the finalization of the seniority matter of Dy. Collectors/Special Grade Deputy Collectors and DSP (Civil), Addl. SP (Civil) and SP (Non Cadre), the Chief Secretary, Government of Andhra Pradesh informed the Committee that he had recently reviewed the status with the concerned Departments. The representatives of these two Departments have assured that the preparation of seniority list will be completed by the end of September 2017.c. Allocation of Superintendents of Prohibition and Excise:

The Chief Secretary, Government of TS was requested to expedite finalization of the seniority list of Assistant Excise Superintendent of Multi Zone-III to enable the Government of AP to finalize the combined seniority of Excise Superintendents. The Member Secretary was requested to explore the possibility of filing a Misc. Application, in consultation with the concerned Department and AG, requesting the Hon’ble High Court for early hearing and to accord permission for initiating the process of final allocation.

d. Allocation of pending cases of Director of Medical Education:

The recommendation of the AC for allocation of Dr. K. Subhakar (Prof. of TBCD) and Dr G. Madhavi, (Asst.Prof. in Anaesthesia) to TS was referred back to the AC. They are both locals to AP. During the meeting, the Member Secretary informed that though they are husband & wife they are both eligible to be allocated to TS as per their option cum seniority. Accordingly, the AC upheld the decision of the Sub-Committee to allocate them to TS.

The following seven cases are deferred in view of the ‘Interim Stay ‘granted by the Hon’ble High Court judicature at Hyderabad:

e. Allocation of pending cases of Director of Health

Dr. D. Rakesh Naik, Civil Assistant Surgeon, is a local candidate of AP by virtue of studying in Korukonda Sainik School, Vizianagaram. He is recommended for allocation to Telangana State as per his option on spouse ground as his wife Smt. Dharawath Swetha is working as Assistant Engineer in District RWS & S Engineer Office, Vikarabad District. Similar decision was taken by the AC in the case of Dr.M. Sreedhar, Associate Professor in SPM (DME) who was finally recommended for allocation to TS on spouse ground.

However, the following three cases are deferred in view of the ‘Interim Stay’ granted by the Hon’ble High Court judicature at Hyderabad:

  3. Dr. G. Madhuri

f. Allocation of Additional Commandants and Commandants

The Committee recommended the allocation of the following four employees as proposed by the Sub-Committee of State Advisory Committee.

With regard to the final allocation of Sri Ravi Madhava Rao & Sri Shaik Anwar Basha, Commandants, the Chief Secretary, Govt. of Andhra Pradesh was requested to explore the possibility of accommodating them in Andhra Pradesh.

g. Allocation of Sri.P.V.Murali Sagar, Addl. Commissioner Labour

The Committee recommended the allocation of Sri Surya Prasad and Sri P.V. Murali Sagar Addl. Commissioners of Labour to Andhra Pradesh. Post Good is in TS:

a. 24 Section Officers waiting for posting orders and salary:

The final allocation of the 24 SOs has been completed. The current issue does not come under the purview of the Advisory Committee. The Chief Secretaries of AP and TS were, however, requested to explore the possibility of finding a mutually agreed solution.

Shri Rao’s date of birth was revised vide G.O.Ms. No.131 Revenue (Excise) Department, Government of TS dated 1/6/2016 from 9/7/1955 to 20/1/1957. With the change in DOB he is deemed to have been in service as on 1/6/2014 and therefore is eligible to be allocated as per the Final Allocation Guidelines. Accordingly, the Committee recommended his allocation to Telangana on notional basis.

c. Allocation of Sri.J.Ravi Prakash, Warder, Central Prison, Charlapalli

Shri Prakash was under punishment of removal from service from 11/2/2013 and therefore was not considered for allocation. However he has been reinstated by the Government of TS vide G.O. Rt. No. 91 dated 21/1/2016. Hence, he is eligible to be allocated. The Committee has, accordingly, recommended his allocation to Andhra Pradesh.

d. Note on Employees in Last Grade Services (Class-IV category) in the General Subordinate Services in the Secretariat Departments and Heads of the Departments who are local to TS, opted to TS and allotted to AP.

It was decided that since the final allocation of these employees is already completed, the issue is not within the purview of the State Advisory Committee. It was therefore decided that the matter may not be included in the Agenda for the next meeting. The Chief Secretaries of AP and TS were however, requested to explore the possibility of finding amicable solution.

a) Review petition of Dr. P.V. Praveen Kumar, In-charge Professor of Anesthesia

Dr. Praveen Kumar was on medical leave undergoing treatment for cancer at the time of publication of notification calling for option. Hence he was allocated to Andhra Pradesh. The Committee considered his case on humanitarian grounds of medical hardship and recommended his allocation to the State of Telangana in the category of Associate Professor Anesthesia.b) Unilateral repatriation / relief of AP nativity / origin employees working in the Government and Government Institutions in the State of Telangana:

With the permission of the Chair the Chief Secretary, Government of Andhra Pradesh raised the issue of continuing unilateral repatriation/relief of employees from the Government and Government Institutions in the State of Telangana on the grounds of Andhra nativity/origin and stated that this is a matter of serious concern to the Government of Andhra Pradesh. He cited the recent repatriation of three employees from Telangana Division of State Financial Corporation as an example. The Secretary (P), Chairman, SAC, requested the Chief Secretary, Government of Telangana to take steps to see that this stops immediately. The Chief Secretary, Government of Telangana informed that he is not aware of the repatriation of employees by the State Financial Corporation and assured to issue clear instructions to all concerned to ensure that this does not continue.
