The 12th meeting of the Advisory Committee, held in Hyderabad on June 5, 2015, addressed several key issues regarding the allocation of posts and personnel. The committee approved revisions to Forms II and IV A, detailing provisional cadre strength and notifications for various departments. They also ratified tentative allocations and discussed the status of state-level institutions, deciding to treat non-gazetted posts as local and gazetted posts as state-wide. A proposal to divide HQ posts based on geographic concentration of work was approved. Furthermore, the committee reviewed requests for modifying guidelines in favor of state cadre employees whose spouses are employed in central government or PSUs, ultimately deciding to move the Government of India for prospective amendments without affecting existing allocations. The allocation of posts and personnel for the Legislature Secretariat and pending cases for cadre strength notification in several departments, including Police and Medical Services, were also discussed and actions were agreed upon. Finally, proposals concerning the General Administration (V&E) Department and the allocation of single-filled posts based on local candidature were noted.

MINUTES OF THE $12^{\text {th }}$ MEETING OF THE ADVISORY COMMITTEE HELD ON 05.06.2015 AT HYDERABAD

AGENDA ITEMS

  1. Recording of the Minutes of the $11^{\text {th }}$ Meeting of the Advisory Committee held on the $26^{\text {th }}$ February, 2015 at Hyderabad.

Minutes of the 11th meeting of the Advisory Committee was recorded except in respect of item 9 in so far as it related to preferential allocation in favour of state cadre employees having spouse in central government or Central public authority.
2. Action taken on the decisions of the earlier Meetings of the Advisory Committee

Action taken on the decisions of the earlier Meetings of the Advisory Committee was noted.
3. Approval/ ratification of Form II and Form IV A notifications made since the last meeting.

4. First revision of Form II and Form IV A from 26.02.2015 to 05.06.2014 in the light of the representations and suggestions received on provisional cadre strength of the following departments notified calling options :

Committee noted the comments and suggestions received upon notification of cadre strength in respect of the above departments placed before it, the recommendations on the same, and the proposed revision of cadre strength as a consequence as reflected in the attached revised statements in Form II and Form IV A and approved and ratified the same.

5. Approval of Tentative allocations notified

Advisory Committee approved and ratified the tentative allocations notified.
6. State level institutions and offices under the Presidential Order – request for reconsideration

Committee discussed the status of the following institutions and noted that in so far as the MNJ Cancer Hospital is a society it is outside the purview of the Committee. In respect of the remaining institutions it was decided that the non gazetted categories of posts may be treated as local and the gazetted categories as state wide to be divided in suitable proportion between the Two States. TheSecretaries of SR of the two states will advise on the proportion in which the State level posts can be divided between the two States.

i. College of Nursing, Hyderabad,
ii. Dental wing of Osmania Medical College, Hyderabad, (Government Dental College & Hospital) and
iii. Radium Institute of Cancer Hospital, Hyd (MNJIO&RCC), Hyd (Under Director of Medical Education)
iv. State Health Museum (Under Director of Health)
v. Nizamia Tibbi College and Hospital, Hyderabad (Indian Medicine & Homeopathy)

  1. Division of HQ posts otherwise than on population criteria- consideration and approval of proposal in respect of certain departments

The division of state level posts done in respect of the head of the department office of Pay & Accounts office, State level Institution of State Trading circle in the Forests department, and the State Ports Department as jointly proposed based on geographic concentration of work by the Heads of departments together with residuary action thereof was approved. Action taken/ in process to determine cadre strength and make tentative allocation of personnel were ratified.

It was decided that as the Ports Department will hereafter serve the State of AP exclusively and there will be no posts allocated to Telangana State and as such no allocation of personnel of the department will be made to it and therefore no options will be called from the employees of the department.

  1. Allocation priorities- requests for modification of Guidelines in favour of State cadre employees whose spouses are employed in Central Government or Central Government institutions

The Advisory committee in its 11th meeting, considering the recommendations of the Chief Secretaries of Telangana and A.P., resolved to move the Government of India to make provision in the guidelines for accommodating the employees whose spouses are in Central government/Central Government institution employment by modifying the Allocation Guidelines with prospective effect without adversely affecting allocations already made pending amendments. It was also resolved in the above meeting that tentative allocations may go on without being held up pending modification of the Guidelines and that it will be up to the Governments to consider such cases if any in departments the tentative allocations of which have already been notified.

The Chief Secretary, Telangana, while stating that the matter should come for confirming the minutes, mentioned that based on the likely numbers involving such cases, no such preference need be considered and there shall not be any preferential allotment to any particular state on theground that the employee’s spouse is working in a PSU/Central Government Departments in a particular place, as it may create an imbalance in the State cadre.

However the Chief Secretary to Govt. A.P., stated that this issue was already discussed and resolved in the $11^{\text {th }}$ meeting of State Advisory Committee. Therefore the C.S to Govt. A.P., is of the view that the Government of India may have to be moved as decided instead of raising these issues for reconsideration of issues already decided

The Chief Secretary, Telangana has not confirmed the previous minutes and no policy change has been indicated by the DoPT so far. The Chairman informed at this stage that he will not be able to recommend the same as there is lack of agreement between both the States.

9. Paragraph 18 (g) \& (j) stand of the Governments of A P and Telangana

The respective stands of the two Governments and the consequent action being taken to make tentative allocations accordingly was noted, approved and ratified.

10. Proposal of Legislature Secretariat

Having regard to the provisions contained in paragraph 22 of the Guidelines Committee decided that the GA SR Departments and the CGG will assist the Legislature department in the allocation of posts and personnel and that the Committee will facilitate the process as laid down in the Guidelines

11. Note on the status of allocation of posts and personnel

The progress of allocation of posts and personnel was noted. Committee requested the State Governments to help expedite the process particularly in the departments where even tentative allocation of cadre strength has not been finalised.

12. Pending cases of notification of cadre strength of remaining Departments- proposal for notification

Committee noted that in the case of the following departments the departments have come to agreed conclusions and that action is being/ will be taken accordingly to notify the cadre strength.
i) Directorate of Treasuries \& Accounts
ii) Directorate of Insurance medical Services
iii) Directorate of Excise and \&Prohibition
iv) Commissionerate of printing \& Stationery
v) Director General \& Inspector General of Police with sub HoDs under himIn respect of the Commissioner / Director of Labour it is decided to delete the posts of Assistant Commissioner of Labour from the cadre strength and to take further action for publishing the notification of provisional cadre strength of the department.

It was decided in respect of the Director of protocol and the A P Special Protection Force the departments may be requested to come up with agreed proposal without any further delay.

  1. Addl agenda item on the allocation of posts & personnel in General Administration (V&E) Dept:

Committee noted and agree to the post proposition of solitary posts as agreed and proposed by the Heads of the departments of GA(V&E) Dept of both the States originally.

  1. Additional item of agenda on allocation of holders of single filled post based on their local candidature as per Presidential order instead of their option.

The issue of amendment to guidelines to enable holders of single post to be allocated based on their local candidature instead of option was discussed. It was resolved that it is not desirable to change guidelines at this point of tome.
