Minutes of the 10th Meeting of the Advisory Committee under the Andhra Pradesh Reorganisation Act, 2014 held on the 28th November, 2014 at New Delhi.

The 10th meeting of the Advisory Committee for State Government Employees was held on the 28th November, 2014 at New Delhi.

The following members attended the meeting:

  1. Action taken on the decisions of the 9th Meeting of the Advisory Committee.

Noted.

  1. Approval of the Advisory Committee for the list of State level offices and institutions, Special Offices and Establishments and Major Development Projects notified under the Presidential Order, which will now be treated as territorial by virtue of their serving one State alone or a part of it and the residuary list of State level offices and Institutions, Special Offices and Establishments and Major Development Projects which will now be treated as State level entities serving both States for purposes of allocation of posts.

Committee noted the fact that certain entities listed in the Presidential Order now stand included in the X schedule to the Act. Committee also noted that certain entities notified in the Presidential Order have now become defunct and no longer exist.

Committee approved the list of entities proposed by the two Governments jointly as territorial serving AP or Telangana as the case may be and the list of State wide institutions serving both the States.

Committee also decided that wherever there is disagreement as to whether an entity is to be treated as territorial or as state wide such entities may now be treated as state wide entities for the purposes of allocation.

  1. To ratify the Provisional notification of cadre strength of the following departments done till the 27th November, 2014, duly following the procedure of obtaining the approval of the Chairman and Chief Secretaries of Andhra Pradesh and Telangana for the provisional notification of cadre strength and division between both the States as delegated in the 9th Meeting of the Advisory Committee.

The provisional notification of the following departments was ratified and the provisional cadre strength and their division between the two States as proposed was approved by the Committee:

  • Chief Commissioner Land Administration
  • Inspector General of Registrations & Stamps
  • Engineer-in-Chief, Rural Water Supply/Chief Engineer, RWS
  • Commissioner/Director, Tribal Welfare
  • Engineer-in-Chief, Panchayat Raj
  • Engineer-in-Chief, Public Health
  • Commissioner/Director, Panchayat Raj
  • Commissioner, Transport
  • Director of Adult Education
  • Director of Prosecutions
  • Commissioner, Resettlement & Rehabilitation
  • Electronically Deliverable Services
  • Commissioner/Director of Industries

The procedure outlined in the note relating to receipt of comments and representations and their examination was also approved.

  1. Proposal on approval of Final cadre strength of departments and tentative allocation of personnel

Committee noted that the Telangana Government and the A P Government want the tentative allocation of personnel to be done as fast as possible so that those provisionally allotted to a State working in the other in respect of whose allocation there is no objection


could be moved by them to the States to which they are tentatively allotted in order to bring stability to the administrations. From the notifications done so far the committee found that there are a large number of single posts and single vacancies in almost all departments the final allocation of which has to wait for the tentative allocation of employees. Similar is the case of isolated posts in respect of which clubbing is to be resorted to. In order not to cause anxiety and suspicion in the minds of employees it had become essential to wait for the final notification of the cadre strength till the tentative allocation is decided by the committee. Committee therefore noted that final cadre strength and its division between the two States are best determined after the tentative allocation of personnel is notified by the committee calling for objections, having regard to the guidelines stipulated at paragraph 12 and recommended final cadre strength of the States for the categories of posts in each department may be notified accordingly, but before the final allocation list of personnel is prepared and notified.

Committee also recommended that the tentative list of employees to be allocated may be drawn up with the help of the heads of departments of the two States in respect of each department by the Member secretary and Secretary (S R ) A P and the Secretary ( S R ) Telangana and the Chairman and that the list so prepared will be circulated to the State representatives on the committee and the Chairperson be authorized to approve the same on behalf of the committee and to notify the tentative allocation notifications calling for representations, if any, by the employees likely to be aggrieved. The tentative allocation lists so notified will be placed before the Committee for ratification and formal approval.

The Committee further advised that the as proposed by the Chief Secretaries to Government of Telangana and Andhra Pradesh they may be allowed to relieve those employees working in one State tentatively proposed to be allocated to the other against whose allocation no objections have been received to move to the State to which they have been allocated after the tentative allocation list of personnel is notified calling for objections. The Committee considered that it would be in the public interest to do so and also beneficial to the employees so allocated. It was noted that it in order to avoid complications it would be necessary to withhold movement of persons against whom objections are raised. The Joint Secretary, DoPT advised that a proposal may be submitted to the Central Government for its consideration and approval. It was accordingly decided by the Committee that the Government of India may be moved to


agree to the recommendations of the Committee made in respect of this subject as outlined above.

The chairperson and the Chief Secretaries called on the Secretary Personnel and appraised him of the proposal and requested him to accede to the above recommendation.
