Maternity Leave Clarification on ‘Threatened Abortion’

This office memorandum clarifies that ‘threatened abortion’ does not equate to ‘abortion’ for the purpose of granting maternity leave under the Central Civil Services (Leave) Rules, 1972. The Department of Personnel & Administrative Reforms issued this clarification after receiving numerous references and consulting with the Department of Health. Consequently, maternity leave will not be granted in cases of threatened abortion. The memorandum is circulated to all relevant departments, ministries, state governments, and other associated bodies.

OFFICE MEMORANDUM

Subject: Maternity leave on account of ‘Threatened Abortion’ – Clarification regarding.

This Department has been receiving a number of references seeking clarification whether ‘Threatened abortion’ amounts to ‘abortion’ for the purpose of grant of maternity leave for a period of six weeks admissible under Rule 43(2) of the Central Civil Services (Leave) Rules, 1972. This has been under consideration of this Department in consultation with the Department of Health and it is now clarified that ‘abortion’ does not include ‘threatened abortion’ and maternity leave cannot be granted in the case of threatened abortion.
