Leave Entitlements of Industrial Employees – Removal of Disparity

This Office Memorandum addresses the issue of disparity in earned leave entitlements between industrial and non-industrial staff in Government establishments, specifically those outside the Railways. It clarifies that enhanced leave benefits, decided upon in 1980 and effective from January 1st, 1981, were incorrectly applied to leave earned during 1980. The memorandum outlines a process for adjusting excess leave taken in 1980 against future leave credits, either in 1982 or subsequent years, in cases where it couldn’t be adjusted against existing leave balances. The decision was made after consultation with the Ministry of Finance.

OFFICE MEMORANDUM

Subject:- Leave entitlements of industrial employees
in Departments other than Railways-Romoval
of disparity in the entitlement of Earned
leave between industrial and non-industrial
staff of the Government Establishments.

The undersigned is directed to invite attention
to this Department’s office memorandum No.12012/1/70-
Eatt.(L) dated the 27th December, 1980, wherein it was
decided to raise the entitlement of annual leave of
industrial employees working in the Departments other
than Railways in pursuance of an Award given by the
Board of Arbitration (JEM). These orders were made
effective w.o.r. 1st January, 1981. It has come to the
action of this Department that the industrial employees
in some Government Departments had been allowed earned
leave on the assumption that the benefit of enhanced
leave were to accrue to them in respect of leave earned
during 1980, whereas the enhanced rate of earning was
to be applicable only for the period beginning 1.1.81.
i.e., in respect of leave to be credited on 1.1.82
Proposals have been received by this department for
adjustment of the excess leave availed of by the
employee during 1981 due to the erroneous interpretation,
against the leave to be earned in subsequent years.

The proposal has been examined in consultation
with the Ministry of Finance and it has been decided
that where the excess leave availed, it could not be
adjusted against the balance of earned leave at credit,
it may be adjusted against the credits afforded on
1.1.1982, failing which in subsequent years.
