Indian Police Service (Pay) Twentieth Amendment Rules, 1998

Important updates have been announced regarding the compensation structure for members of the Indian Police Service (IPS). Effective August 1, 1997, new amendments to the Indian Police Service (Pay) Rules, 1954, introduce revised regulations for the Central (Deputation on Tenure) Allowance. Officers holding posts under the Central Government, particularly those in specific pay scales, will now be eligible for a Central (Deputation on Tenure) Allowance at a rate of fifteen percent of their grade pay. This allowance is capped at a maximum of rupees one thousand per month. The new rules also detail specific changes to the pay structure for various positions, including Deputy Secretaries, Under Secretaries, and Directors, by substituting certain figures in Schedule III of the original rules to reflect increased allowance ceilings. These changes are a direct implementation of recommendations made by the Fifth Central Pay Commission and are applied retrospectively. Rest assured, these amendments are designed to be beneficial and are not expected to adversely affect any member of the Indian Police Service.

Notification

G.S.R.149. In exercise of the powers conferred by sub-section (1) of section 3 of the All India Services Act, 1951 (61 of 1951), the Central Government, after consultation with the State Governments concerned, hereby makes the following rules further to amend the Indian Police Service (Pay) Rules, 1954, namely:

  1. (1) These rules may be called the Indian Police Service (Pay) Twentieth Amendment Rules, 1998.

(2) They shall come into force from the first day of August, 1997.

  1. In the Indian Police Service (Pay) Rules, 1954 (hereinafter referred to as the said rules), for rule 9C, the following rule shall be substituted, namely:

“9C. Regulation of pay of members of the Service appointed to hold posts under the Central Government carrying the scale of pay of Rs.14300-400-18300 – Notwithstanding anything contained in rules 8 and 9, a member of the Service appointed to hold a post under the Central Government in the scale of pay of Rs.14300-400-18300 shall draw his grade pay plus Central (Deputation on Tenure) Allowance at the rate of fifteen per cent of the grade pay subject to a maximum of rupees one thousand per mensem.

Explanation: The Central (Deputation on Tenure) Allowance under this rule shall be admissible to a member of the Service only during the normal tenure of deputation.”

  1. In Schedule III to the said rules, under the heading C. Posts carrying pay above the time scale or Central (Deputation on Tenure) Allowance in addition to pay in the time scale under the Central Government when held by member of Service, under column 5, against Sl.No. 1 to 13, for the figures “500”, “400” and “200”, wherever they occur, the figures “1000”, “800” and “400” shall respectively be substituted.

  1. In Schedule III to the said rules, under the heading D. Posts in the Central Secretariat carrying pay above the time-scale or Central (Deputation on Tenure) Allowance in addition to the time scale when held by members of the Service –

of India (Rs. 14300-400-18300) of India (Rs. 14300-400-18300)

Fifteen per cent of the grade pay subject to a maximum of rupees one thousand per mensem.

OR

(ii) Junior Administrative Grade (Rs. 12000-375-16500) of India (Rs. 12000-375-16500)

Fifteen per cent of the grade pay subject to a maximum of rupees one thousand per mensem and subject also to the condition that pay plus Central (Deputation on Tenure) Allowance shall not exceed the maximum of the grade.

Under Secretaries (i) Junior Administrative Grade (Rs. 12000-375-16500) of India (Rs. 12000-375-16500)

Fifteen per cent of the grade pay subject to the maximum of rupees eight hundred per mensem and further subject to the condition that pay plus Central (Deputation on Tenure) Allowance shall


not exceed the maximum of the scale.

OR

(ii) Senior Time Scale.
(Rs. 10000-325-15200)

Fifteen per cent of the grade pay subject to the maximum of rupees eight hundred per mensem, and subject further to the condition that pay plus Central (Deputation on Tenure) Allowance shall not exceed the maximum of the scale.

EXPLANATORY MEMORANDUM

The Central Government has decided to implement the recommendations made by the Fifth Central Pay Commission relating to the grant of Central (Deputation on Tenure) Allowance in respect of the All India Services with effect from the 1st day of August, 1997. With a view to implement this decision, the Indian Police Service (Pay) Rules, 1954 are being amended accordingly with effect from the 1st day of August, 1997.

It is certified that no member of the Indian Police Service is likely to be adversely affected by giving retrospective effect to these rules.
