Indian Police Service (Pay) First Amendment Rules, 2012

The Ministry of Personnel, Public Grievances and Pensions, through the Department of Personnel and Training, has issued a notification regarding amendments to the Indian Police Service (Pay) Rules, 2007. These amendments, effective from their publication in the official gazette, introduce new provisions for proforma promotions. Specifically, for members of the Service cleared for proforma promotion, the period of service will now count towards initial pay fixation and increments upon reversion to the cadre and appointment to a post in the said scale. This is subject to certain conditions: the member must have been approved by the State Government for the scale, senior members must have started drawing pay in that scale on or before the proforma promotion date, and a vacancy in the higher grade must be available at the time of repatriation from deputation.

NOTIFICATION

New Delhi, the 20th June, 2012
G.S.R. 500(E).- In exercise of the powers conferred by sub-section (1) of section 3 of the All India Services Act, 1951 (61 of 1951), the Central Government afterconsultation with the Governments of the States concerned, hereby makes the following rules further to amend the Indian Police Service (Pay) Rules, 2007, namely:-

  1. (1) These rules may be called the Indian Police Service (Pay) First Amendment Rules, 2012. .
    (2) They shall come into force on the date of their publication in the official gazette.
  2. In rule 6 of the Indian Police Service (Pay) Rules, 2007 (hereinafter referred to as the said rules), for sub-rule (8), the following sub-rule shall be substituted, namely :-
    “(8) In case of a member of the Service being cleared for proforma promotion in a pay band or time scale, the period of his service covered by the proforma promotion shall, on his subsequent reversion to the cadre and appointment to a post in the said scale, count towards the initial fixation of pay and increments subject to the condition that proforma promotion has been granted to him after considering the following points, namely:-
    (i) such member of the Service concerned should have been approved by the State Government for appointment to the said scale during the relevant period;
    (ii) all the members of the Service senior to such member (excluding those considered unfit) should have started drawing pay in that scale on or before the date from which the proforma promotion is granted to him;
