NOTIFICATION

GSE No. 1615 In exercise of the powers conferred by sub-section (1) of Section 3 of the All India Services Act, 1981 (51 of 1982), the Central Government, after consultation with the Governments of the States concerned, hereby makes the following rules further to amend the Indian Forest Service (Pay) Rules, 1988, namely:

  1. (1) These rules may be called the Indian Forest Service (FSC) (Indian Government Rules, 1987).
  2. (1) They shall be deemed to have come into force on the 1st day of January, 1988.

  3. In the Indian Forest Service (FSC) Rules, 1988 (Recruitment) referred to as the sub-rule:
    (1) For sub-rule (1) in rule 2, the following sub-rule shall be substituted, namely:

    “(1) This shall be pay admissible to a member of the Service and the depos force with effect from which the pay series shall be deemed to have come into force, shall be as follows:

    Junior scale: b.2200-75-2900-25-100-4000/-
    with effect from the 1st day of January, 1988.

    Junior scale:
    (1) This scale: b.2200-75-2900-25-100-4000/-
    with effect from 1st January, 1988.

    (1) Junior Administrative Grade: b.2200-125-4700-150-2001/-
    (Non-Junioral) with effect from 1st January, 1988.

    Provided that a member of the service shall be appointed to the Junior scale on his remitting four years of service, subject to the provisions of sub-rule (2) of Rule 5A of the Indian Forest Service (Recruitment) Rules, 1988, and to the Junior Administrative Grade on remitting nine years of service.Note: The four years and nine years of service in this rule shall be calculated from the year of allotment assigned to him under Regulation 2 of the Indian Forest Service (Regulation of Seniority) Rules, 1988.

(iii) Suboption pres: M.4100-128-4990-130-9300/-.

Provided that a member of the service may elect to continue to draw pay in the existing scale until the date on which he earns his next or any subsequent increment in the existing scale or until he vacates his last or ceases to draw pay in the scale. The option shall be exercised in accordance with such orders as may be issued by the Central Government in this behalf.

Publication 1: The option to retain the existing scale under the provision of this rule shall be admissible only in respect of one existing scale.

Publication 2: The aforesaid option shall not be admissible to any person appointed to the service or to enter the 1st day of January, 1986 and he shall be allowed pay only in the revised scale.

Publication 3: Where a member of the service exercises an option under the provision of this rule to retain the existing scale in respect of a test held by him in an officiating capacity on a regular basis for the purpose of regulation of pay in that scale, his substantive pay shall be the substantive pay which he would have drawn had he retained the existing scale in the permanent post on which he holds a plan or would have held a plan had hisnot been suspended or the pay of the officiating post which has required the operator of sub-service pay in accordance with any order for the time being in force which was in higher:

(a) for sub-rule 2 of rule 3, the following sub-rule shall be substituted, namely:

“2.(i) A number of the Service shall be entitled to draw pay in the selection grade only on appointment to that grade.

(ii) The pay of a number of the Service in the Junior Administrative Grade shall, on appointment to the Selection Grade be fixed:

(a) to the stage which is equal to his pay in the Junior Administrative Grade or if there is no such stage, the stage must below that pay plus personal pay equal to the difference to be therewith in future increases in pay, or

(b) the minimum of the Selection Grade, which was in higher.

(iii) The new increment in the Selection Grade would accrue after rendering the sequence qualifying service in that grade.

Provided that all leave one of the extraordinary leave taken otherwise than on initial certificate, shall count for increment in the Selection Grade.

Provided further that the General Government may, in any case, in which it is satisfied that the extraordinary leave was taken for any cause beyond the control of the number of the Service or for prosecuting higher Scientific or Technical studies, direct the such extraordinary leave shall be counted for increments under this sub-rule.”

(c) for rule 48, the following rule shall be substituted, namely:

“48. Election of pay of an officer:

The individual pay of a number of the Service who elects or deems to have elected, in accordance with the rules,to be governed by the revised scale on and from the first day of January, 1966 or from a later date, shall be revised from that date separately in respect of the pay drawn in a substantive or officiating capacity in the following manner:-
(i) an amount representing $20 \%$ of the basic pay in the existing scale subject to a minimum of $3.75 /-$ shall be added to the “existing emoluments” of the number of the service.
(ii) after the existing emoluments have been so increased, the pay shall thereafter be fixed in the revised scale at the stage next above the amount thus computed : Provided that if the amount as computed is less than the minimum of the revised scale, the pay shall be fixed at the minimum of that scale :
Provided further that if the amount so computed is more than the maximum of the revised scale, the pay shall be fixed at the maximum of that scale.
Explanation : For the purpose of this sub-rule, “existing emoluments shall include –
(a) the basic pay in the existing scale ;
(b) the dearness pay, additional dearness allowance and all-hoc dearness allowance appropriate to the basic pay admissible at index average 606 (1960 : 100); and
(c) the amounts of first and second instalments of interim relief admissible on the basic pay in the existing scale.
(iii) In the case of members of service who are in receipt of special pay in addition to pay in the existing scales and in whose case special pay continues with the revised scale of pay either at the same rate or at a different rate, the pay in the revised scale shall be fixed in accordance with the provisions of this sub-rule with reference to the existing emoluments and uleted in accordance with the Explanationtharote, after excluding the existing special pay and the amounts admissible thereon with reference to dearness pay, additional dearness allowance and ad-hoc dearness allowance, and in such cases special pay at the new rate shall be drawn in addition to the pay so fixed in the revised scale:

NOTE 1: Where a number of the service is holding a permanent post and is officiating in a higher post on a regular basis and the scales applicable to these two posts are merged into one scale, the pay shall be fixed under this sub-rule with reference to the officiating post only, and the pay so fixed shall be treated as substantive pay.

NOTE 2: Where the existing amoluments as calculated in accordance with this sub-rule exceed the revised amoluments in the case of any number of the service, the difference shall be allowed as personal pay to be absorbed in future increases in pay.

NOTE 3: Where in a fixation of pay under this sub-rule the pay of the members of the service drawing pay at more than five consecutive stages in an existing scale gets bunched, that is to say, gets fixed in the revised scale at the same stage, the pay in the revised scale at each of the members of the service who are drawing pay beyond the first five consecutive stages in the existing scale shall be stepped up to the stage where such bunching occurs, as under, by the grant of increment(s) in the revised scale in the following manner, namely:

(a) for members of service drawing pay from the 6th up to the 10th stage in the existing scale by one increment;

(b) for members of the service drawing pay from the 11th up to 15th stage in the existing scale, if there is bunching beyond the 10th stage – by two increments.

If by stepping up of the pay as above, the pay of a member of the service gets fixed at a stage in the revised scale which is higher than the stage in the revised scale at which the pay of the member of the service who was drawing pay at the next other stage or stages in the same existing scale fixed, the pay of the latter shall be stepped up only to the extent by which it falls short of that of the former.NOTE 4: There is the fixation of any under this sub-rule the pay of a member of service who, in the existing scale was drawing immediately before the 1st January, 1986 more pay than another member of the service junior to him in the same cadre, gets fixed in the revised scale at a stage lower than that of such junior, his pay shall be stopped up to the same stage in the revised scale as that of the junior.

NOTE 5: Where a member of the service is in receipt of personal pay of the 1st day of January, 1986 which together with his existing emoluments as calculated in accordance with this sub-rule exceeds the revised emoluments, then, the difference representing such excess shall be allowed to such member of the service as personal pay to be absorbed in future increases in pay.

NOTE 6 In cases, where a senior member of the service promoted to a higher post before the 1st day of January, 1986, draws less pay in the revised scale than his junior who is promoted to the higher post on or after the 1st day of January, 1986, the pay of the senior member of the service should be stopped up to an amount equal to the pay as fixed for his junior in that higher post. The stopping up should be done with effect from the date of promotion of the junior member of the service subject to the fulfilment of the following conditions namely:

  • (a) both the junior and the senior member of the service should belong to the same cadre and the posts in which they have been promoted should be identical in the same cadre;
  • (b) the pre-revised and revised scales of pay of the lower and higher posts in which they are entitled to draw pay should be identical and;
  • (c) the anomaly should be directly as a result of the application of the provisions of this sub-rule. If even in the lower post, the junior officer was drawing more post in the pre-revised scale than the senior by virtue of any advance farements granted to him, provisions of this Note need not be invoked to stop up the pay of the senior officer.3. In Rule 4 of the said rule,
    (i) for sub-rule (3), the following shall be substituted namely:

    “the pay of a number of the service in the junior scale shall, on appointment to a post on the senior time scale be fixed at the stage next above the pay nationally arrived at by increasing his pay in the lower scale by one increment at the stage at which such pay accrued (or by an amount equal to the last increment in the lower scale if he was drawing pay at the maximum of the lower scale) or the minimum of the senior time scale whichever is higher.”

    (ii) the following sub-rule shall be inserted, namely:

    “3 (A) The pay of the number of the service in the senior time scale shall, on appointment to junior Administrative Grade, be fixed (a) to the stage which is equal to his pay in the senior time scale or if there is no such stage, the stage next below that pay plus personal pay equal to the difference to be absorbed in future increase in pay or (b) the minimum of the Junior Administrative Grade, whichever is higher.”

    “3 (B) The pay of a number of the service in the Selection Grade shall, on appointment to the pre-rain, be fixed at the same maximum as in sub-rule (3) above.”4. In Rule 5 of the said rules,
    (1) for sub-rul(s)(2), the following sub-rul(s) shall be substituted, namely:

    “(2) In the case of a member of the Service recruited under Rule 7 of the Indian Administrative Service (Recruitment) Rules, 1954, increment in the junior scale and senior time scale and Junior Administrative Grade shall accrue on completion of one year’s service in the junior scale, senior time scale or the Junior Administrative Grade, as the case may be, subject to the provisions of sub-rul(s)(5)”

    (11) for sub-rul(s)(5), the following sub-rul(s) shall be substituted, namely:

    (5) The next increment of a member of the Service whose pay has been fixed under rule 42 shall accrue to him on the date on which it would have accrued to him in the scale of pay applicable to him immediately before the 1st day of January, 1966.

Provided that in cases where the pay of a member of the Service is steeped up under rule 42 the next increment shall be granted on the completion of qualifying service of twelve months from the date of the stepping up of the pay in the revised scale:

Provided further that in cases other than those covered by the preceding provirg the next increment of a member of the Service whose pay is fixed on the 1st day of January, 1966, at the same stage as the one fixedfor another number of the service junior to him in the same cadre and drawing pay at a lower stage than his in the existing scale; shall be granted on the same date as admissible to his junior, if the date of increment of the junior happens to be earlier;

Provided also that in the case of persons who had been drawing maximum of the existing scale for more than a year as on the 1st January, 1926, next increment in the revised scale shall be allowed on the 1st day of January, 1926.

NOTE 1. Whenever the pay has been fixed in terms of the above provisos the efficiency bar will become operative only with reference to such bars in the revised scale, irrespective of whether a member of the service had crossed or not crossed or had been held up at the efficiency bar in the existing scale.

NOTE 2. Where by the grant of additional increment in terms of the third proviso in the revised scale applicable to the substantive post, the substantive pay of a member of the service may be allowed, in addition to officiating pay, the difference between the officiating pay and substantive pay as personal pay to be absorbed in future increments for the periods during which the substantive pay exceeds officiating pay.

After rule 5 of the said rules, the following rule shall be inserted, namely:

“A disposition thereunto. A member of the service drawing pay and the new scale/senior scale/junior administers the provision of service to the increment for every two years of service and the new scale, subject to a maximum of three increments.”

NOTE: The statement thereunto shall be in the nature of provision of service, not be made into account for the purpose of fixation of pay on promotion to higher post or for applying a selling on pay plus special pay under the rules.- 10 –

In the said rules, Schedule I shall be deleted.

  1. In Schedule II to the said rules, for the words and figures “first day of January, 1973” appearing in clauses (i), (ii), (iii) and (iv), the words and figures “first day of January, 1986” shall be substituted;

  2. In Schedule III to the said rules, (1) under the heading “A – posts carrying the pay above the time scale in the Indian Forest Service under the State Government”, in column number 3, for the figures 2500-125/S-2750; 2250-125/E-2500; 2000-125/S-2250 and 1800-100-2000; the figures 5900-200-6700; 5900-200-6700; 4500-150-5700 and 4500-150-5700 respectively shall be substituted;- 11 –

(ii) under the heading “E-Posts carrying pay in the senior time scale of the Indian Forest Service under the State Governments, including posts carrying special pay in addition to pay in the time-scale”, for clause (2), the following clause shall be substituted, namely:

“(B) The amount of any special pay which may be sanctioned by the State Governments under clauses (2) shall be Rs. 200/-, Rs. 300/-, or Rs. 400/-, as may, from time to time, be determined by the State Government concerned:

Provided that pay plus special pay shall not exceed the maximum of the scale to which special pay is attached”;

(iii) under the heading under “C-Posts carrying pay in the time scale under the Central Government when held by the members of the Service”:

(i) for the figures 2800/-, 2000/-, 2800-2720/-, 2000-1800/-, 2000-1820/-, 1800-2000/-, 2000-2020/-, and 2800-1820/-; 2000/-, 2000/-, 2000-1820/-; 2800-2020/-; 2000/-, 2800-2720/-; 2800-1820/-; 2800-1820/-; 2800-1820/-; 2800-1820/-; 2800-2720/-; and 2800-2020/-; 2800/- respectively shall be substituted;

(ii) for the entries:

“Deputy Secretary to the (i) Selection Grade” Rs. 200/-

“Government of India” (ii) Senior Scale Rs. 200/-

The following entries shall be substituted, namely:

“Deputy Secretary to the (i) Selection Grade of” Rs. 600/-

The Central Government has decided to implement
the decisions taken on the recommendations made by the
Fourth Central Party Commission relating to revision of
scales of pay in respect of the All India Services and
the Central Civil Services Group ‘A’ with effect from the
1st January, 1986.

The Indian Forest Service (Rs.3.111 s, 1100, or
being amended accordingly with effect from the 1st January,
1986.

It is surmised that no number of the Indian Forest
Service is likely to be adversely affected by this
notification being given retrospartive effect.# NOTE 2.

The Municipal Rules were notified vide Notification No. 2/11/ 68-AIS(IV) dated 25.09.68 as 99th No. 482 dated 16.3.68 and Indian Present Service (Pay) Rules, 1968, has been changed vide Notification given below:
