Indian Administrative Service (Pay) Third Amendment Rules, 2009

Attention all public service professionals! A significant update to the Indian Administrative Service (Pay) Rules, 2007, has been announced, effective retrospectively from January 1, 2006. These new provisions, officially known as the Indian Administrative Service (Pay) Third Amendment Rules, 2009, introduce crucial changes to the pay structure for officers.

Specifically, the previous Pay Band-4 of Rs.37400-67000 plus Grade Pay of Rs.12000, applicable to the Above Super Time Scale of IAS, has been replaced. The new structure implements a Higher Administrative Grade (HAG) scale ranging from Rs.67000 to Rs.79000, with an annual increment of 3%.

For officers promoting to the Super Time Scale, their pay will now be fixed by adding a 3% increment to their current pay in Pay Band-4 and existing grade pay, rounded up to the nearest multiple of 10. This amount, combined with the Super Time Scale’s grade pay, forms the new pay in the pay band.

Furthermore, for those moving from the Super Time Scale to the HAG scale, the pay fixation involves a similar 3% increment calculation based on Pay Band-4 and existing grade pay, plus an additional Rs.2000. This calculation ensures the new Basic Pay in the HAG scale adheres to the minimum of Rs.67000 and does not exceed the maximum of Rs.79000.

It’s important to note that these amendments are designed to ensure fair compensation and have been certified not to adversely affect any member of the Indian Administrative Service, despite their retrospective application.

NOTIFICATION

New Delhi, the 13th August, 2009
G.S.R. 572(E).-In exercise of the powers conferred by sub-section (1) of section 3 of the All India Services Act, 1951 (61 of 1951), the Central Government after consultation with the Governments of the States concerned, hereby makes the following rules further to amend the Indian Administrative Service (Pay) Rules, 2007, namely:-

  1. (1) These rules may be called the Indian Administrative Service (Pay) Third Amendment Rules, 2009.
    (2) They shall be deemed to have come in force on the 1st day of January, 2006.2. In rule 3 of the Indian Administrative Service (Pay) Rules, 2007 (hereinafter referred to as the said rules), for clause (i) of part D of the sub-rule (1), the following shall be substituted, namely :-
    “(i) HAG Scale: Rs. 67000 – (annual increment @ 3\%) – 79000”
  2. In rule 4 of the said rules, for sub-rule (7), the following sub-rules shall be substituted, namely:-
    “(7) The pay of a member of the Service in the Selection Grade, on promotion to the Super Time Scale, shall be fixed by adding one increment equal to $3 \%$ of the sum of the pay in the pay band -4 and the existing grade pay, computed and rounded off to the next multiple of 10 , to the existing pay in the pay band -4 and the grade pay corresponding to the Super Time Scale, shall be granted in addition to this pay in the pay band.;
    (7A) The pay of a member of the Service in the Super Time Scale, on promotion to the HAG scale shall be fixed in the following manner:-

After adding one increment equal to $3 \%$ of the sum of the pay in the pay band – 4 and the existing grade pay, computed and rounded off to the next multiple of 10 , to the existing sum of pay in the pay band -4 and the grade pay of the Super Time Scale, a sum of Rs. 2000 shall be added to arrive at the new Basic Pay in HAG scale which will be subject to a minimum of Rs.67000. The Basic Pay in HAG scale shall not exceed Rs. 79000 , the maximum of scale.”
4. In Schedule II of the said rules,-
(a) in PART-A, for the words and figures “Pay Band-4: Rs.37400-67000 plus Grade Pay Rs.12000”, wherever they occur, the words and figures “Rs.67000-(annual increment @ 3\%)-79000” shall be substituted.
(b) in PART-C, in the TABLE, in column (2) regarding Scale of Pay, for the words and figures “Pay Band-4: Rs.37400-67000; and Grade Pay Rs. 12000 ” the words and figures “Rs. 67000 – (annual increment @ $3 \%)-79000^{\prime \prime}$ shall be substituted.Note : The principal rules were published in the Gazette of India, Extraordinary vide number G.S.R. 213(E), dated the $20^{\text {th }}$ March, 2007 and subsequently were amended vide numbers as follows:

EXPLANATORY MEMORANDUM

The Central Government has decided to replace Pay Band-4: Rs.3740067000 plus Grade Pay Rs. 12000 applicable to Above Super Time Scale of IAS by the HAG scale of Rs.67000-(annual increment @ 3\%)-79000. The Indian Administrative Service (Pay) Rules, 2007 are being amended accordingly with effect from the $1^{\text {st }}$ January, 2006.

It is certified that no member of the Indian Administrative Service is likely to be adversely affected by giving retrospective effect to these rules.
