Indian Administrative Service (Pay) Fourth Amendment Rules, 2010

Significant updates have been introduced concerning the pay structure for members of the Indian Administrative Service, especially those advancing to the Higher Administrative Grade (HAG) scale. A recent amendment now provides an option for officials promoted to the HAG scale (ranging from Rs. 67000-79000) to elect for their pay to be fixed starting from the 1st of July in the year they would typically receive their next increment in the lower scale. This new system ensures that upon promotion, an amount of Rs. 2000 is added to their basic pay, subject to a minimum of Rs. 67000. Furthermore, on the subsequent 1st of July increment date, their pay will be re-fixed. This re-fixation considers their basic pay before promotion and includes two increments: one for the annual increment and another specifically granted due to the promotion. These beneficial changes have been enacted with retrospective effect from January 1, 2006, ensuring that the revisions apply to past promotions, without any anticipated adverse impact on any member of the service.

New Delhi, the 8th April, 2010
G.S.R. 298(E).-In exercise of the powers conferred by sub-section (1) of Section 3 of the All India Services Act, 1951 (61 of 1951), the Central Government after consultation with the Governments of the States concerned, hereby makes the following rules further to amend the Indian Administrative Service (Pay) Rules, 2007, namely :-

  1. (1) These rules may be called the Indian Administrative Service (Pay) Fourth Amendment Rules, 2010.
    (2) They shall be deemed to have come in force on the 1 st day of January, 2006.
  2. In Rule 4 of the Indian Administrative Service (Pay) Rules, 2007, after sub-rule (8) the following sub-rule shall be inserted, namely :-
    “(8A) On promotion to the HAG scale of Rs. $67000-79000$, if a member of the Service opts to have his pay fixed from the 1 st day of July of the year, the date on which he subsequently earns an increment in the lower scale in the manner provided in sub-rule (1) of rule 5 , then on the date of promotion, his pay shall be fixed by adding an amount of Rs. 2000 to his basic pay, subject to a minimum of Rs. 67000 and further re-fixation of pay on the date of next increment in the lower scale, falling on the 1 st day of July, shall be done by taking into account his basic pay prior to the date of promotion and adding thereto two increments, one on account of annual increment and the second on account of promotion.”

EXPLANATORY MEMORANDUM

The Central Government has decided to provide option to the members of the Service for fixation of their pay on promotion to the HAG scale by inserting a new sub-rule 8A to Rule 4 of the Indian Administrative Service (Pay) Rules, 2007 with retrospective effect from the 1st January, 2006.

It is hereby declared that no member of the Indian Administrative Service is likely to be adversely affected by such retrospective effect.
