Notification

G.S.R….In exercise of the powers conterred by sub-section (1) ot section 3 of the All India Services Act. 1951 (61 of 1951), the Central Government. atter consultation with the State Governments concerned, herebv makes the following rules further to amend the Indian Administrative Service (Pay) Rules, 1954, namely:-

1. (1) These rules may be called the Indian Administrative Service (Pay) Fifth Amendment Rules, 1998.
   (2) They shall come into force from the first day of August, 1997.
2. In the Indian Administrative Service (Pay) Rules, 1954 (hereinafter reterred to as the said rules), for rule 9C, the following rule shall be substituted, namely:-
   “9C. Regulation of pay of members of Service appointed to hold posts under the Central Government carrying the scale of pay of Rs.14300-400-18300.- Notwithstanding anything contained in rules 8 and 9 , a member of the Service appointed to hold a post under the Central Government in the scale of pay of Rs.14300-400-18300 shall draw his srade pay plus Central (Deputation on Tenure1 Allowance at the rate of fifteen per cent of the grade pay subject to a maximum of rupees one thousand per mensem.

Explanation:-The central (Deputation on Tenure) Allowance under thie rule shall be adetasible to a eanber of tho service only during tho normal tenure of doputation.
3. In Schedule III to the said rules. under the heading C. Posts carrvins pay above the time-scale or Central (Deputation on Tenure) Allowance in addition to pay in the time scale under the Central Government when held by members of the Service. for S.Nos. 4, 5 and 6 and the entries relating thereto,

the following S.Nos. and the entries shall be substituted. namely:- 12 14

eight hundred per mensem and further subject to the condition that pay plus Central (Deputation on Tenure) Allowance shall not exceed the maximum of the scale.”

EXPLANATORY MEMORANDUM

The Central Government has decided to implement the recommendations made by the Fifth Central Pav Commission relating to the grant of Central (Deputation on Tenure) Allowance in respect of the All India Services with effect from the 1st day of August, 1997. With a view to implement this decision, the Indian Administrative Service (Pay) Rules. 1954 are being amended accordinglv with effect from the 1st day of August, 1997.

It is certified that no member of the Indian Administrative Service is likely to be adversely affected by giving retrospective effect to these rules.
