Indian Administrative Service (Pay) Fifth Amendment Rules, 1998: Deputation Allowance Regulation

The Central Government has introduced new regulations for civil servants, specifically those belonging to the Indian Administrative Service (IAS) who are serving on deputation to the Union Government. These significant updates, officially known as the Indian Administrative Service (Pay) Fifth Amendment Rules, 1998, came into effect retrospectively from August 1, 1997. A key provision is the establishment of a Central (Deputation on Tenure) Allowance. This allowance applies to IAS officers holding various Central Government posts, including Director, Deputy Secretary, and Under Secretary, particularly those in specific pay scales such as Rs.12750-375-16500 and Rs.15100-400-18300. The allowance is calculated at fifteen percent of the officer’s grade pay, with a maximum cap of Rs. 1,000 per month for certain roles and Rs. 800 per month for others. It is crucial to note that this allowance is only granted during the officer’s standard deputation tenure, and the total remuneration, including this allowance, must not exceed the maximum of the respective pay scale. These amendments were implemented to align with recommendations from the Fifth Central Pay Commission, updating the pay framework for these deputed officers. Importantly, the government has affirmed that the retrospective application of these rules will not negatively impact any member of the Indian Administrative Service.

Notification

G.S.R.168. In exercise of the powers conferred by sub-section (1) of section 3 of the All India Services Act, 1951 (61 of 1951), the Central Government, after consultation with the State Governments concerned, hereby makes the following rules further to amend the Indian Administrative Service (Pay) Rules, 1954, namely: –

  1. (1) These rules may be called the Indian Administrative Service (Pay) Fifth Amendment Rules, 1998.

(2) They shall come into force from the first day of August, 1997.

  1. In the Indian Administrative Service (Pay) Rules, 1954 (hereinafter referred to as the said rules), for rule 9C, the following rule shall be substituted, namely: –

“9C. Regulation of pay of members of Service appointed to hold posts under the Central Government carrying the scale of pay of Rs.14300-400-18300.- Notwithstanding anything contained in rules 8 and 9, a member of the Service appointed to hold a post under the Central Government in the scale of pay of Rs.14300-400-18300 shall draw his grade pay plus Central (Deputation on Tenure) Allowance at the rate of fifteen per cent of the grade pay subject to a maximum of rupees one thousand per mensem.

Explanation:-The Central (Deputation on Tenure) Allowance under this rule shall be admissible to a member of the Service only during the normal tenure of deputation.”

  1. In Schedule III to the said rules, under the heading C. Posts carrying pay above the time-scale or Central (Deputation on Tenure) Allowance in addition to pay in the time scale under the Central Government when held by members of the Service, for S.Nos. 4, 5 and 6 and the entries relating thereto,

the following S.Nos. and the entries shall be substituted, namely:-

“4. Director to the Government of India Selection Grade (Rs. 15100-400-18300) Fifteen per cent of the grade pay subject to the maximum of Rs. one thousand per mensem.
5. Deputy Secretary to the Government of India (i) Selection Grade (Rs. 15100-400-18300) Fifteen per cent of the grade pay subject to the maximum of Rs. one thousand per mensem.
OR
(ii) Junior Administrative Grade (Rs. 12750-375-16500) Fifteen per cent of the grade pay subject to the maximum of Rs. one thousand per mensem and further subject to the condition that pay plus Central (Deputation on Tenure) Allowance shall not exceed the maximum of the scale.
6. Under Secretary to the Government of India (i) Junior Administrative Grade (Rs. 12750-375-16500) Fifteen per cent of the grade pay subject to the maximum of Rs. eight hundred per mensem and further subject to the condition that pay plus Central (Deputation on Tenure) Allowance shall not exceed the maximum of the scale.
OR
(ii) Senior Time Scale. (Rs. 10650-325-15850) Fifteen per cent of the grade pay subject to the maximum of rupees

eight hundred per mensem and further subject to the condition that pay plus Central (Deputation on Tenure) Allowance shall not exceed the maximum of the scale.”

EXPLANATORY MEMORANDUM

The Central Government has decided to implement the recommendations made by the Fifth Central Pay Commission relating to the grant of Central (Deputation on Tenure) Allowance in respect of the All India Services with effect from the 1st day of August, 1997. With a view to implement this decision, the Indian Administrative Service (Pay) Rules, 1954 are being amended accordingly with effect from the 1st day of August, 1997.

It is certified that no member of the Indian Administrative Service is likely to be adversely affected by giving retrospective effect to these rules.
