Shri V.C. Tripathi, Assistant, has been included in the Common Seniority List of Assistants of CSS for the year 1995. This decision follows the directions of the Hon’ble CAT, Principal Bench, Delhi, in its judgement dated September 4, 2003, and inputs from the Ministry of Labour. Shri Tripathi’s seniority was restored, and he was placed in the grade of UDC in the Seniority List of 1989 and promoted to Assistant in the Select List for the year 2005.

OFFICE MEMORANDUM
Subject: Inclusion of name of Shri V.C. Tripathi, Assistant in the CSL of Assistants for the year 1995 .
The undersigned is directed to refer to Ministry of Labour \& Employment’s OM NO. A-23011/02/2007-Admn.I dated $23^{\text {rd }}$ September, 2009 on the subject noted above and to say that the Common Seniority List of Assistant for the year 1995 was circulated vide this Department’s OM of even number dated 17.04.2007.
2. The Hon’ble CAT, Principal Bench, Delhi, in its judgement dated $4^{\text {th }}$ September, 2003 in OA No. 3277/2002 with OA No. 1/2003 in the case of Shri K.L. Gandhi Vs UOI and Shri V.C. Tripathi Vs UOI directed to restore the seniority of Shri V.C. Tripathi in the the Seniority List of UDC of 1989. Accordingly, Ministry of Labour vide its Office Order No. C-18012/4/2003-Admn. I dated $8^{\text {th }}$ December, 2003 placed Shri Tripathi in the grade of UDC in the Seniority List of 1989 and also promoted him as Assistant and placed him in the Select List of Assistant for the year 2005.
3. As per the inputs provided by the Ministry of Labour, the name of Shri V.C. Tripathi, Assistant is being incorporated in the Common Seniority List of Assistants of CSS for the year 1995 as given below:
