Consequently, the government has endorsed this recommendation, maintaining the officer’s assignment to the successor state. Union of India and other linked cases – Decision on the representations of Shri Manoj Chandra Pandey, Police Radio, Home Department.
Sir,
I am directed to refer to the order dated 12-12-2007 of the Hon’ble Allahabad High Court, Lucknow Bench vide which the Government of India / State Advisory Committee was directed to consider the representation of Shri Manoj Chandra Pandey, and to say that his representation was accordingly considered by the Advisory Committee headed by Joint Secretary (SR) in its meeting held on 01-12-2010. Shri Pandey has mentioned the following grounds in his representation in support of his request for revision of allocation from Uttarakhand to U.P. :-
i) He was born and studied in U.P.
ii) Option given for allocation to U.P.
iii) Appointed on compassionate grounds
iv) Domicile mentioned as Almora in the service records of father
v) Blockage in the path from ureter to kidney after the operation to remove stone in kidney.
vi) Properties in U.P.
vii) Mother bed-ridden and no benefit taken from Uttarakhand in service life.
3. Since the grounds mentioned in his representation, as brought out above, are not covered under the guidelines on Reorganisation, the Committee recommended to reject his representation seeking revision in allocation.
- The Government of India has accepted the recommendations of the Committee and accordingly the allocation of Shri Manoj Chandra Pandy remains unchanged and continues to be the successor State of Uttarakhand. The officials concerned may kindly be apprised of the position.
