Government Decision on Pharmacist’s Allocation as per High Court Order

Fairness and due process are cornerstones of public service, especially when it comes to personnel allocation. A recent government decision has brought resolution to a long-standing issue concerning a Pharmacist’s placement. Following a directive from the High Court, a dedicated committee diligently reviewed the representation. Their findings revealed that the Pharmacist in question was an eligible optee and a domicile of Uttarakhand. Critically, it was also identified that another individual, initially allocated under the juniormost OBC category, had been incorrectly placed. Based on the committee’s comprehensive recommendations, the government has now formally allocated the Pharmacist to Uttarakhand under the OBC category, ensuring their rightful placement. Correspondingly, the allocation of the other individual has been revised to Uttar Pradesh, correcting the previous error. This move underscores the commitment to upholding judicial mandates and ensuring equitable distribution of personnel within government departments.

Subject: Compliance of Hon’ble High Court Allahabad’s directions in WP No.40965/2006 -Decision on the representations of Shri Narendra Singh Lingwal, Medical & Health Deptt.-reg.

Sir,

I am directed to refer to the direction of the Hon’ble High Court of U.P. at Allahabad in W.P. No. 40965/2006 dated 12.12.2007 and to say that the representation of Shri Narendra Singh Lingwal, Pharmacist was considered by the Committee headed by Dr. S.K. Sarker, Joint Secretary in its meeting held on 24.8.2009. The Committee found that Shri Narendra Singh Lingwal is an optee and domicile of Uttarakhand. The name of Shri Manoj Kumar, OBC allocated under juniormost category was wrongly included in the TFAL. The Committee therefore, recommended to allocate Shri Narendra Singh Lingwal to Uttarakhand under OBC category and revise allocation of Shri Manoj Kumar to Uttar Pradesh.

The Government of India has accepted the recommendation of the Committee and accordingly Shri Narendra Singh Lingwal stands allocated to Uttarakhand and the allocation of Shri Manoj Kumar stands revised to Uttar Pradesh. Officers concerned may kindly be apprised of the position.
