In a recent development concerning government service matters, a long-standing case regarding a junior assistant’s career progression has reached a decisive point. Following directives from the High Court of Allahabad, a dedicated committee was constituted to review the representation made by the employee concerning his promotion from a Class-IV position to Junior Assistant in 1999. The committee’s thorough review revealed that this promotion was intricately linked to the outcome of an older High Court writ petition (WP No.3602/98) filed by a Class-IV employees’ association. Consequently, the committee concluded that while the matter could be reconsidered, it would only be appropriate if the individual were to be reverted to his original Class-IV post, contingent on the final judgment of the older writ petition. Based on these findings, the committee recommended rejecting the current representation and maintaining the individual’s existing state allocation. This recommendation has been accepted by the Government, bringing clarity to the specific service matter.

Sir,
I am directed to refer to the direction of the Hon’ble High Court of Allahabad, Lucknow Bench order dated 12.12.2007 and to say that the representation of Shri Dileep Kr. Sharma was considered by the Committee headed by Dr. S.K. Sarker, Joint Secretary in its meeting held on 24.8.2009. The Committee found that the representation has been submitted on the grounds that his promotion from class-IV to Jr. Assistant in 1999 is subject to the outcome of WP No.3602/98 filed by Class-IV employees Association & Others in High Court. The Committee was of the view that the case can be considered as per the guidelines if the petitioner is reverted to the post Class-IV employee as an outcome of WP No.3602/98. The Committee therefore, recommended to reject his representation and not to change his allocation from Uttarakhand to Uttar Pradesh subject to reconsideration if he is reverted to Class-IV as an outcome of WP No.3602/98.
The Government of India has accepted the recommendation of the Committee and accordingly Shri Dileep Kr. Sharma, Jr. Assistant, Naveen Prabhag remains allocated to Uttarakhand subject to reconsideration if he is reverted to Class-IV as an outcome of WP No.3602/98. Officer concerned may kindly be apprised of the position.
