Government Decision on Dues and Pension for Employees Allocated by Central Government but Not Relieved

This communication from the Department of Personnel & Training, Ministry of Personnel, P.G. and Pensions, addresses the case of the late Shri Raghuveer Kureel, an employee of Rajya Niyojan Sansthan, Planning Department. The State Advisory Committee decided that if an employee allocated by the Government of India dies before being relieved due to a court stay order, their dues and pension should be paid by the State where they were working prior to their death. The letter directs that Shri Kureel’s case be processed accordingly and that this decision be communicated to all State Government Departments for compliance.

Sir,

I am directed to refer to the subject noted above and to say that the State Advisory Committee in its meeting held on 20.10.2009 considered the case of Late Shri Raghuveer Kureel, Rajya Niyojan Sansthan, Planning Deptt. The Committee decided that if an employee who has been finally allocated by the Government of India but is not relieved in view of the stay order of the Court, dies before getting relieved, in that case all his dues/pension etc. would be paid by the State, he was working with before his death.

The case of Late Shri Raghuveer Kureel may kindly be processed accordingly. The above position may also be brought to the notice of all the Departments of the State Government for compliance.
