Government Decision on Assistant Accountant Shri Sunil Rai’s Allocation to Uttarakhand Following High Court Order

The government has recently finalized a significant personnel decision concerning an Assistant Accountant in the Jail Department, Shri Sunil Rai. Following an order from the Hon’ble High Court, Lucknow Bench, a dedicated committee diligently reviewed the representations submitted by Shri Rai. After careful consideration, including a meeting held on June 23, 2009, the committee concluded that Shri Rai’s allocation to Uttarakhand was fully compliant with existing guidelines for the juniormost category. It was determined that the personal grounds cited for his appeal, specifically his mother’s illness and the impact on his children’s education, did not fall within the purview of the State Reorganization guidelines. Consequently, the committee recommended the rejection of his representation, a recommendation which has now been officially accepted by the Government of India. This means Shri Rai will continue his service in Uttarakhand as per the original allocation.

Subject: Decision on the representations submitted by Shri Sunil Rai, Asstt. Accountant, Jail Department in compliance of High Court Allahabad, Lucknow Bench order dated 12.12.2007.
Sir,
I am directed to refer to the directions of the Hon’ble High Court, Lucknow Bench order dated 12.12.2007 on the subject cited above and to say that the representation of Shri Sunil Rai, Asstt. Accountant was considered by the Committee headed by Dr. Sarkar, JS in its meeting held on 23.6.2009. The Committee found that his allocation to Uttarakhand as per recommendations of SAC under juniormost category is as per guidelines. Further the ground of his mother’s illness and disruption in children’s studies is not covered under the guidelines of State Reorganization and as such recommended for rejection of the representation.

The Government of India has accepted the recommendation of the committee and accordingly Shri Sunil Rai, Asstt. Accountant shall continue in Uttarakhand. Officer concerned may kindly be apprised of the position.
