सा.का.नि. 203(अ).—राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, मूल नियमावली में आगे और संशोधन करने के लिए एतदद्वारा, निम्नलिखित नियम बनाते हैं, अर्थात् :—

  1. (1) इन नियमों का नाम मूल (संशोधन) नियमावली, 2009 है ।
  2. (2) ये नियम शासकीय राजपत्र में इनके प्रकाशन की तारीख को लागू होंगे ।
  3. मूल नियमावली में नियम 56 के खण्ड (घ) में पांचवें परंतुक के पश्चात् निम्नलिखित परंतुक अंत:स्थापित किया जाएगा, अर्थात् :—

“बशर्ते यह भी कि पांचवें परन्तुक में किसी बात के होते हुए भी केन्द्र सरकार यदि लोकहित में ऐसा करना आवश्यक समझें, तो वह गृह सचिव और रक्षा सचिव को सेवा की दो वर्ष की उपर्युक्त अवधि के पश्चात् अधिकतम 3 माह की अगली अवधि के लिए सेवा में विस्तार दे सकती है ।”

MINISTRY OF PERSONNEL, PUBLIC GRIEVANCES AND PENSIONS (Department of Personnel and Training) NOTIFICATION

New Delhi, the 26th March, 2009
G.S.R. 203(E).-In exercise of the powers conferred by the proviso to Article 309 of the Constitution, the President hereby makes the following rules further to amend the Fundamental Rules, namely :-

  1. (1) These rules may be called the Fundamental (Amendment) Rules, 2009.
    (2) They shall come into force on the date of their publication in the Official Gazette.
  2. In the Fundamental Rules, in rule 56, in clause (d), after the fifth proviso, the following proviso shall be inserted, namely :-
    “Provided also that notwithstanding anything contained in the fifth proviso, the Central Government may, if considers it necessary, in public interest, so to do, give an extension in service for a further period not exceeding three months beyond the said period of two years to the Home Secretary and the Defence Secretary.”
