अधिसूचना नई दिल्ली, 29 मई, 2006

सा का नि. 322(अ) – राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए मूल नियमों में आगे और संशोधन करने के लिए एदत्‍द्रास, निम्नलिखित नियम बनाते हैं, अर्थात् :-

1. (1) इन नियमों का नाम मूल (संशोधन) नियम, 2006 है।

(2) ये नियम शासकीय राजपत्र में अपने प्रकाशन की तारीख से लागू होंगे।

1. मूल नियमों के नियम 56 के खण्ड (घ) के चौथे परन्तुक के स्थान पर निम्नलिखित परन्तुक प्रतिस्थापित किए जाएंगे, अर्थात् :- “परन्तु यह भी कि किसी भी नियम में निहित किसी भी बात के होते हुए, केन्द्रीय सरकार, यदि लोक हित में ऐसा करना आवश्यक समझे तो केन्द्रीय सरकार में मंत्रिमण्डल सचिव का कार्यकाल उतनी अवधि अथवा अवधियों के लिए बढ़ा सकती है जो वह उचित समझे, बशर्ते कि मंत्रिमण्डल सचिव के रूप में उनका कुल कार्यकाल तीन वर्ष से अधिक न हो :

परन्तु यह भी कि केन्द्र सरकार, यदि लोक हित में ऐसा करना आवश्यक समझे तो रक्षा सचिव, गृह सचिव, निदेशक, आयूचना ब्यूरो, सचिव, अनुसंधान तथा विश्लेषण स्कंध और निदेशक, केन्द्रीय अन्वेषण ब्यूरो का केन्द्र सरकार में कार्यकाल, मामला दर मामला आधार पर उतनी अवधि के लिए बढ़ा सकती है जितनी वह उचित समझे, बशर्ते कि ऐसे सचिवों अथवा निदेशकों, जैसा भी मामला हो, जिन्हें सेवा में इस तरह की वृद्धि दी गई है, इस नियम के अधीन उनका कुल कार्यकाल दो वर्ष से अधिक न हो।”

MINISTRY OF PERSONNEL, PUBLIC GRIEVANCES AND PENSIONS (Department of Personnel and Training) NOTIFICATION

New Delhi, the 29th May, 2006
G.S.R. 322(E).-In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules, further to amend the Fundamental Rules, namely :-

1. (1) These rules may be called the Fundamental (Amendment) Rules, 2006.
   (2) They shall come into force on the date of their publication in the Official Gazette.

1. In the Fundamental Rules, in rule 56, for the fourth proviso to clause (d), the following provisos shall be substituted, namely :-

Provided also that notwithstanding anything contained in any rule, the Central Government may, if considered necessary in public interest so to do, give extension in service to a Cabinet Secretary in the Central Government for such period or periods as it may deem proper subject to the condition that his total term as such Cabinet Secretary does not exceed three years:

Provided also that the Central Government may, if considered necessary in public interest so to do, give extension in service to the Defence Secretary, Home Secretary, Director of the Intelligence Bureau, Secretary, Research and Analysis Wing and Director, Central Bureau of Investigation, in the Central Government for such period or periods as it may deem proper, on a case to case basis, subject to the condition that the total term of such Secretaries or Directors, as the case may be. who are given such extension in service under this rule does not exceed two years. ${ }^{-}$.
