Fundamental (Amendment) Rules, 2005 – Extension of Service for Key Government Officials

This notification details amendments to the Fundamental Rules, specifically regarding the extension of service for key government officials including the Cabinet Secretary, Defence Secretary, Home Secretary, and Directors of Intelligence and Investigation agencies. The extension is granted at the discretion of the Central Government, based on public interest, and is capped at a maximum of two years. Notification

G.S.R. (E) – In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules, further to amend the Fundamental Rules, namely:-

  1. (1) These rules may be called the Fundamental (Amendment) Rules, 2005.
    (2) They shall come into force on the date of their publication in the Official Gazette.
  2. In the Fundamental Rules, in rule 56, for the fourth proviso to clause (d), the following shall be substituted, namely:-
    “Provided also that the Central Government may, if it considers necessary in public interest so to do, give extension in service to the Cabinet Secretary, Defence Secretary, Home Secretary, Director, Intelligence Bureau, Secretary, Research and Analysis Wing and Director, Central Bureau of Investigation, for such periods as it may deem proper, on case to case basis, subject to the condition that the total term of the incumbents of the above posts who are given such extension in service, does not exceed two years”.
