Final Allocation of PCS Officers to Uttarakhand

For years, the allocation of three Provincial Civil Service (PCS) officers – Vinay Shankar Pandey, Surendra Narayan Pandey, and Vinod Kumar Suman – between Uttar Pradesh and the newly formed state of Uttarakhand was a contentious issue. Initially recommended for Uttarakhand in 2002, the officers challenged this decision, leading to a protracted legal battle that reached the Supreme Court. While the apex court had initially granted a stay on their allocation, the officers eventually withdrew their Special Leave Petitions. This pivotal development paved the way for a resolution. Following a thorough review and recommendation by an Advisory Committee, the Government of India has now formally confirmed their allocation to Uttarakhand. This decision, made under the provisions of the U.P. Reorganization Act, 2000, is effective retrospectively from November 9, 2000, the state’s formation day, finally bringing clarity to their service postings.

Sub. :-Final allocation of S/Shri Vinay Shankar Pandey, Surendra Narayan Pandey and Vinod Kumar Suman, PCS officers.

Sir,
Allocation of PCS officers was considered by the State Advisory Committee in its meeting held on 04.12 .2002 in which, besides others, S/Shri Vinay Shankar Pandey, Surendra Narayan Pandey and Vinod Kumar Suman, were recommended for allocation to Uttarakhand on juniority basis. Several PCS officers including these three had approached Hon’ble Allahabad High Court against their proposed allocation to Uttarakhand. However, the Hon’ble Court dismissed the WPs under order dt. 11.12.2003. They then moved the Hon’ble Supreme Court against the order through a bunch of SLPs, in response to which the apex court granted stay on the Allahabad High Court judgment against their allocation to Uttarakhand. Central Govt. issued final allocation order dt. 22.04.2003, excluding the officers, who had obtained stay.
2. Three of the above mentioned officers have withdrawn their SLPs and the Hon’ble Supreme Court in its order dated 21.01.2011 has dismissed the SLPs filed by them, as withdrawn. Two of the officers, viz, S/Shri Surendra Narayan Pandey and Vinod Kumar Suman, have also submitted representations to the State Govt., endorsing a copy to this Department, requesting for their final allocation, consequent upon withdrawal of the SLPS. The matter was discussed in the last meeting of the Advisory Committee headed by JS(SR), Deptt. of Personnel and Training, Govt. of India, held on 14.02.2011. The Committee recommended for issue of their final allocation order as there is no legal impediment for doing so.
3. The Govt. of India has accepted the recommendation of the Committee and accordingly, in exercise of powers conferred under Section 73(2) of the U.P.


Reorganization Act, 2000, hereby allocates S/Shri Vinay Shankar Pandey, Surendra Narayan Pandey and Vinod Kumar Suman, all PCS officers, to the successor State of Uttarakhand w.e.f. 09.11.2000, i.e., the appointed day.
4. The officers may be apprised of the allocation.
