Navigating complex personnel allocations following state reorganizations can often lead to intricate legal and administrative challenges. A recent communication sheds light on the resolution of such a matter, involving employees from the Medical Education and AYUSH Department (Ayurveda). This case stemmed from a series of court directives, notably from the Allahabad High Court, regarding writ petitions concerning the allocation of staff. The court had previously issued specific instructions for a committee to review representations from employees, ensuring decisions were made transparently and communicated promptly. One particular employee, a junior clerk, had sought re-allotment to Uttar Pradesh, citing reasons such as his appointment on a supernumerary post and discrepancies in the allocation of sanctioned posts between the newly formed states. He argued that his original allocation to Uttarakhand was flawed given these circumstances. However, a government committee, after thorough deliberation, concluded that there was no functional difference between regular cadre posts and supernumerary cadre posts in this context. Consequently, the committee rejected the employee’s request for re-allotment and recommended that his current allocation to Uttarakhand be maintained. This recommendation has now been formally accepted by the central government, solidifying the employee’s final allocation to Uttarakhand. This decision underscores the intricate process of harmonizing employee interests with administrative frameworks during state division, emphasizing adherence to established policies and judicial pronouncements.

संबन्धित रिट याचिका संख्या 4413 (S/S)/2005 में माननीय इलाहाबाद उच्च न्यायालय,
लखनऊ खंडपीठ के दिनांक 17-02-2009 को पारित आदेश जिसके द्वारा 12-12-2007 को रिट
याचिका संख्या 58/2006 – शेर सिंह बनाम भारत सरकार एवं अन्य में पारित आदेश के अनुसार
कार्यवाही करने का आदेश – का निपटान ।
महोदय,
मुझे उपर्युक्त विषय के संदर्भ में यह कहने का निदेश हुआ है कि माननीय इलाहाबाद उच्च
न्यायालय, लखनऊ खंडपीठ ने अपने दिनांक 12-12-2007 के आदेश में निम्नलिखित आदेश पारित किया है :-
“Keeping in view the circular dated 12-11-2007, the instant appeal is disposed of
directing the Committee concerned to decided the appellant’s representation in
accordance with law by passing a speaking and reasoned order expeditiously and
preferably within a period of 3 weeks from the date of receipt of a certified copy of
this order and communicate the decision to the appellant within next one month and
during this period the appellant shall be allowed to discharge his duties in the State
of U.P. on the posts on which he has been promoted and will be paid his salary.”
- रिट याचिका से संबंधित एक अन्य याची श्री हितेश मणि शर्मा, कनिष्ठ लिपिक ने अपने प्रत्यावेदन
में उत्तर प्रदेश पुनरावंटन के लिए निम्नलिखित कारण दिया है :-
i) मृतक आश्रित अधिसंख्यक पद पर तैनात होने एवं कनिष्ठ लिपिक के स्वीकृत / रिक्त पद
के विरुद्ध अध्यतन समायोजित न होने
- ii) उत्तराखंड शासन के पत्र दिनांक 18-10-2004 के प्रस्तर 5 में “अधिसंख्यक कनिष्ठ लिपिक आवंटन कि श्रेणी में न आने के कारण आवंटन स्वीकार नहीं किया गया”।
- iii) वर्ष 2000 में कनिष्ठ लिपिक के स्वीकृत 18 पदों में शासनादेश का अनुसार 3 पद ही उत्तराखंड राज्य हेतु आवंटित होने के आधार पर त्रुटिपूर्ण आवंटन निरस्त किए जाने का अनुरोध किया गया है।
- समिति की पूर्व बैठक में निर्णय लिया जा चुका है कि संवर्गीय पद और संवर्ग के अधिसंख्यक पद पर कोई भिन्नता नहीं है। अतः समिति ने श्री हितेश मणि शर्मा, कनिष्ठ लिपिक का प्रत्यावेदन निरस्त करते हुए उनके उत्तराखंड राज्य आवंटन को यथावत बनाए रखे जाने की सस्ती की गयी।

भारत सरकार समिति की सस्ती से सहमत है तथा तदनुसार श्री हितेश मणि शर्मा, कनिष्ठ लिपिक, का अंतिम आवंटन उत्तराखंड राज्य के लिए बना रहेगा। संबन्धित कार्मिक से स्थिति के बारे में अवगत करवा दिया जाए।
