OFFICE MEMORANDUM

Subject: Designation of the Central Public Information Officers in the Organisations specified in the second schedule of the Right to Information Act, 2005.

The undersigned is directed to say that sub-section (1) of Section 24 of the RTI Act, 2005 provides that nothing contained in the Act shall apply to the intelligence and security organizations specified in the Second Schedule or to any information furnished by such organizations to the Government. However, this provision does not exempt these organizations from the purview of the Act in respect of the information pertaining to the allegations of corruption and human rights violations. Thus, the citizens have a right, though limited, to seek information from these organizations. Therefore, it is necessary that these organizations too designate Central Public Information Officers to deal with the RTI applications.

1. The Act does not contain any special provision about the method of supply of information in respect of allegations of corruption by the above referred organizations. It, however, provides that information in respect of allegations of violation of human rights shall be given only after the approval of the Central Information Commission. In either case, it is possible that the applicant may not receive a decision within the time specified or he may be aggrieved by the decision communicated to him. In such a case, he may like to exercise his right to appeal as provided in section 19 of the Act.

2. Keeping above facts in view, all the organizations specified in the Second Schedule of the RTI Act, 2005 are advised to designate Central Public Information Officers (CPIO) immediately, if it has not been done so far. These organizations are also advised to specify the First Appellate Authorities within the organizations and publish the details of the CPIOs and the Appellate Authorities.

विषय:- सूचना का अधिकार अधिनियम, 2005 की दूसरी अनुसूची में विनिर्दिष्ट संगठनों में केन्द्रीय जन सूचना अधिकारियों को नामित करना।

अधोहस्ताक्षरी को यह कहने का निदेश हुआ है कि सूचना का अधिकार अधिनियम, 2005 की धारा 24 की उप-धारा (1) में यह प्रावधान है कि उक्त अधिनियम में उल्लिखित कोई भी विषय-सामग्री दूसरी अनुसूची में विनिर्दिष्ट आसूचना और सुरक्षा संगठनों अथवा ऐसे संगठनों द्वारा सरकार को दी गई किसी भी जानकारी पर लागू नहीं होगी। तथापि, यह प्रावधान भ्रष्टाचार और मानवाधिकार उल्लंघनों के आरोपों से संबंधित जानकारी के संबंध में इन संगठनों को उक्त अधिनियम के कार्य क्षेत्र से छूट नहीं देता है। इस प्रकार, नागरिकों को, सीमित ही सही, लेकिन इन संगठनों से सूचना मांगने का अधिकार है। इसीलिए, यह आवश्यक है कि वे संगठन भी सूचना का अधिकार से संबंधित आवेदनों का निपटारा करने के लिए केन्द्रीय जन सूचना अधिकारियों को नामित करें।

1. इस अधिनियम में, उपर्युक्त संगठनों द्वारा भ्रष्टाचार के आरोपों के संबंध में सूचना भेजने की विधि के बारे में कोई विशेष प्रावधान नहीं है। तथापि, इसमें यह प्रावधान है कि मानवाधिकार उल्लंघन के आरोपों के संबंध में सूचना केन्द्रीय सूचना आयोग के अनुमोदन के बाद ही दी जाएगी। दोनों ही स्थितियों में यह संभव है कि आवेदक को विनिर्दिष्ट समय के भीतर कोई निर्णय प्राप्त न हो अथवा सूचित किए गए निर्णय से वह व्यथित हो। ऐसी स्थिति में, वह अधिनियम की धारा 19 में दिए गए प्रावधान के अनुसार अपने अपील के अधिकार का प्रयोग कर सकता है।

2. उपर्युक्त तथ्यों को ध्यान में रखते हुए, सूचना का अधिकार अधिनियम, 2005 की दूसरी अनुसूची में विनिर्दिष्ट संगठनों को यह सलाह दी जाती है कि वे केन्द्रीय जन सूचना अधिकारियों को शीघ्र नामित करें, यदि अब तक ऐसा नहीं किया गया है। इन संगठनों को यह भी सलाह दी जाती है कि वे संगठनों के भीतर प्रथम अपील प्राधिकारियों को विनिर्दिष्ट करें तथा केन्द्रीय जन सूचना अधिकारियों और अपील प्राधिकारियों के ब्यौरे प्रकाशित करें।
