A dedicated committee, after careful consideration of his representation and existing allocation guidelines, found that while 57 Head Constable posts were designated for Uttarakhand, 54 personnel had already been assigned. Following the protocol that dictates the junior-most personnel in the domicile category are prioritised for initial postings to Uttarakhand, the committee recommended accepting Shri Thapa’s request for allocation under this category. This recommendation has since been fully endorsed by the Government, ensuring his posting to Uttarakhand. Subject: Compliance of Hon’ble High Court Nainital’s directions in W.P. No.1186/2006 – Decision on the representation of Shri Mahesh Thapa, Excise Constable
Sir,
I am directed to refer to the direction of the Hon’ble High Court of Uttarakhand at Nainital in W.P. No. 1186/2006 dated 04.04.2007 and to say that the representation of Shri Mahesh Thapa, Excise Constable was considered by the Committee headed by Dr. S.K. Sarker, Joint Secretary in its meeting held on 24.8.2009. The Committee found that a total 57 posts of Head Constables were allotted to Uttarakhand and against these posts, 54 personnel (51 optee+ 3 domicile) were finally allocated to Uttarakhand. Further the three persons allocated under domicile Category are senior to Shri Mahesh Thapa. As per guidelines, in the domicile Category, junior most personnel are sent to Uttarakhand first. Hence, the Committee recommended to accept his representation for allocation to Uttarakhand under domicile category.
The Government of India has accepted the recommendation of the Committee and accordingly Shri Mahesh Thapa, Excise Constable stand allocated to Uttarakhand. Officer concerned may kindly be apprised of the position.
