Sub: Consideration of representations of Shri Parasnath Singh, in compliance of the directions dated 17/11/2009 of Hon’ble High Court of Allahabad, Lucknow Bench, Writ Petition No.7238(S/S)/2009 – regarding

Sir,
I am directed to refer to the subject noted above and to say that Hon’ble High Court of Allahabad, Lucknow Bench in W.P. No.7238(S/S)/09 directed that “Keeping in view the circular dated 12.11.2007, the instant appeal is disposed of directing the Committee concerned to decide the appellant’s representations in accordance with law by passing a speaking and reasoned order expeditiously and preferably within a period of three weeks from the date of receipt of a certified copy of this order and communicate the decision to the appellant within next one month and during this period the appellant shall be allowed to discharge his duties in the state of U.P. on the post on which he has been promoted and will be paid his salary”.
2. Shri Parasnath Singh, in his representation dated 24.11.2009 has raised the following grounds:
(i) He is 53 years $s$ id and eligible for full pension.
(ii) He is presently working on the post of Sub-inspector (Spl Category)
(iii) He has been included as juniormost for the year 2002-2003 whereas he is getting promotion pay w.e.f. 01.06.1996.
3. The representation of Shri Parasnath Singh received in compliance of the directions of the Hon’ble High Court of Allahabad, Lucknow Bench was considered by the Advisory Committee in its meeting held on 14.02.2011. The Committee was informed that the promotion given to him is honorary and not substantive. Other points raised by him are also not covered under the guidelines on Reorganisation. The Committee, therefore recommended for rejection of his representation for revision of allocation to Uttar Pradesh.4. The Government of India has considered the representation as well as the recommendations of the Committee and decided to accept the recommendation. Accordingly, Shri Parasnath Singh, continues to be allocated to the successor State of Uttarakhand. The officer/official concerned may kindly be apprised of the decision.
