Subject: Compliance of directions of the High Court of Allahabad, Lucknow Bench dated 12.12.2007 in W.P. No.434(S/S)/2006 -Decision on the representations of Shri Dilshad Hussain, Sr. Assistant, Naveen Prabhag regarding –

Sir,

I am directed to refer to the direction of the Hon’ble High Court of Allahabad, Lucknow Bench order dated 12.12.2007 and to say that the representation of Shri Dilshad Hussain was considered by the Committee headed by Dr. S.K. Sarker, Joint Secretary in its meeting held on 24.8.2009. The Committee found that he was regularized vide order dated 22.4.2002 w.e.f. 9.12.1983 and hence was a regular State Cadre Employee on the appointed day. The Committee therefore, recommended to reject his representation and not to change his allocation from Uttarakhand to Uttar Pradesh.

The Government of India has accepted the recommendation of the Committee and accordingly the allocation of Shri Dilshad Hussain, Sr. Assistant, Naveen Prabhag, continues to be in the successor State of Uttarakhand. Officer concerned may kindly be apprised of the position.
